Scorpion repudiated my claim. This Email to them, which they have not responded to, says it all:
The repudiation of my claim is ******** for the following reasons:
Your contention that there is not a “reasonable prospect of success” depend on how you interpret success.
The claim against me is for R 1,000,000 which the Lawyer (Mr Basson) has made clear in his report is absurd and if the case is lost, which I do not believe will be the case and is a “worst case scenario”, the maximum that would be awarded against me would not exceed R10,000, or maximum 10% of the claim. The reasonable man would regard this as successful in terms of litigation. This would be a successful conclusion.
Your insurance is misleading in the extreme if you demand a near 100% probability of winning the case outright as the measure for success.
I further place the following on record:
1. Your service has been terrible and as the extended deadline negotiated with the opposing side expires tomorrow, grossly negligent and/or careless. 2. It is simply not possible to find another lawyer or an advocate to set up a reasonable case by then. 3. Your negligence / carelessness has therefore greatly jeopardised a favourable outcome of my case.
I reserve all rights to take the matter further, including Hello Peter, Social Media, the relevant Law Society and the insurance Ombud. The public need to know the truth about how your company can conduct a claim.
I also formally regard that you have repudiated my policy and regard the policy as cancelled with immediate effect. Should you deduct any further fees from my account, I will make a case of theft against your company.
I also demand the repayment of all fees to date.
This email was ignored and they just continued debiting my account as "Business as Usual". So *********** they cannot even get my name right!
I cancelled my policy om 29 June 2021 when they repudiated my claim. With this they effectively also repudiated my policy. What is a policy worth if a provider can just refer to an obscure clause to avoid liability?
Then they send me an email which demonstrated clearly that thy are fully aware of how difficult and time consuming it would be to oppose their repudiation. Just not worth it.
They ********ly deducted a payment on 14 July 2021 (unnoticed by me and 2 weeks after had I cancelled my policy) and again on 15 August 2121. The later was reversed by my bank. With the former I had waited too long not having noticed it. For R103 I am not going to pursue it. But they are still ********ly in possession of that payment.
They are already trying to deduct additional payments. Will have to waste the time to keep having the payments reversed.
I really do not want to have anything to do with these people that left me dangling at the last minute with no legal representation. Who wants to continue with a policy provider you cannot trust?
