Mediocre service delivery

On the 26th November 2017 I approached Scorpoin legal protection to assist me against my employer who had retrenched via email with 2days notice. In sort the lawyers chosen by Scorpion to represent me to accept the settlement offered by the employer (which was close to nothing) in order to avoid lengthly CCMA procedure. I recieved the settlement at the end of January with the promise that all documentation required to submit at the Dept of Labour (UIF) would follow shortly. To date i have recieved only excuses from my previous employer regarding his UIF documentation or proof that Payments were ever made to the UIF dept. since my employment. the Department as no record of such on thier system and cannot assist me unless documentation is produced indicating otherwise.

The lawyers are aware of this dilemma, yet nothing as been done to remedy such. I personally feel that these lawyers have done more to protect my previous employer than myself, whist Scorpion's call center continues to call me on a weekly basis asking me to pay my monthly premium, but have failed to assist me with the case at hand. I would like to express my disappointment at the outcome of this case, All decisions that have been taken so far were based on your recommendations, yet it seems as though the only person who has benefited from this exercise is the employer. I am no better off than I was when we started the process with nothing to show for it. To date I am no closer to submitting my UIF documents, let alone a payout. I’m no law expert, but I’m sure that there being no UIF contributions paid during the period I was employed is a violation on its own…. If it had been paid, then there would be a paper trail. UIF has no record of such. I just don’t see how this service has been of any benefit to me

We confirm that Ms Thavamanie Naidoo, Regional Manager responsible for the Labour Claims department, has contacted you regarding this complaint and that she has discussed it with you in full detail. Further that you acknowledge that the former employer has paid you in line with the settlement agreement and that your concern relates to the UI.19 form to enable you to claim from the Department of Labour.

We are currently discussing this with your attorney, Jarvis Jacobs Inc, to ensure that necessary documents are obtained timeously from the employer. We will keep you posted on further developments.
