SAYA RECOVERIES HARRASMENT
Dear Saya Recoveries,
RE: FORMAL COMPLAINT REGARDING EXCESSIVE PAYMENT REMINDERS AND UNWANTED CONTACT
I hereby wish to lodge a formal complaint regarding the repeated emails, SMS messages and telephone calls I receive from your company every month, despite consistently making my agreed payments on time.
I have honoured my payment arrangement and continue to do so. There is therefore no reasonable justification for repeatedly contacting me before the end of each month to remind me to make a payment that is not yet overdue.
I find this repeated communication unnecessary, intrusive and unacceptable. I am fully aware of my payment obligations and do not require multiple reminders to fulfil an arrangement that I have consistently honoured.
I request that Saya Recoveries immediately review its communication practices in respect of my account and cease sending repetitive, premature payment reminders through multiple channels.
I understand that debt collectors have a legitimate right to pursue outstanding debts. However, this right must be exercised professionally and within the boundaries of applicable legislation. The Debt Collectors Act 114 of 1998 and the applicable Code of Conduct prohibit excessive harassment and require debt collectors to respect the dignity and civil rights of debtors.
Should I fail to make a payment when it is due, I accept that you may contact me regarding the overdue amount. However, I do not accept being subjected to repeated calls, emails and SMS messages before my agreed payment deadline has passed.
I therefore request the following:
Written confirmation that my payment arrangement and payment history have been reviewed. Immediate cessation of repetitive reminders before my agreed payment due date. Confirmation that your records correctly reflect my payments and that my account is not incorrectly flagged as being in arrears. Confirmation of the steps you will take to prevent this unnecessary communication from continuing. Please treat this email as a formal complaint. Should this conduct continue, I reserve the right to submit a written complaint to the Council for Debt Collectors and any other relevant regulatory body.
I expect a written response within 10 business days.
I trust that this matter can be resolved without further escalation.
You do not have to accept constant pre-payment reminders if you are honoring an agreed payment plan. The law protects you against unfair and overly aggressive collection tactics through several frameworks: • The National Credit Act (NCA): Debt collectors are legally prohibited from threatening, intimidating, or continuously harassing consumers. Debt collection efforts must be reasonable. Continuous automated spamming for an account that is fully up-to-date breaches the spirit of fair collection practices. • The Protection of Personal Information Act (POPI Act): Under POPIA, you have the right to object to how your personal information is used for direct communication. If you demand that they stop contacting you via specific channels (like automated text blasts) because your account is compliant, they must respect that boundary. • Debt Collectors Act (Act 114 of 1998): Registered debt collectors are regulated by the Council for Debt Collectors. Their code of conduct strictly forbids conduct that defames, oppresses, or harasses a consumer.
Kind regards, Martin Williams
