wrongful deductions
My cousin brother resigned from his job. He was paid lumpsum upon resignation and some money was deducted on his payout for tax purposes. Unfortunately the employer put wrong figures on the IRP5 that was submitted to SARS. Upon noticing this earror, the employer sent another IRP5 with the correct amounts showing exact tax deducted from my cousins provident fund. When SARS received the 2nd IRP5, they assumed my cousin had been paid another lumpsum but they didn't receive any monies due to them for tax hence they went in to my cousins account and took more money for tax. My cousin ended up being taxed twice. When he went to SARS to enquire no one was willing to assist him. The 1st IRP5 showed wrong amount paid to him (less) not what exactly he got (bank statement is available for perusal) and the 2nd shows the actual amount paid to him and the tax he paid. So in short, he was taxed twice for two different lumpsum but only received one. He tried several times to have this resolved but no one was willing to assist him. He even tried private consultants but they also could not get through SARS. We spoke talk to one person from SARS who seemed to understand but he was scare to assist
