SARS Unfair Penalties
This a final kick of a dying horse. I’ve always kept up to speed with my Taxes and maintained a clean compliant record. I was therefore staggered early this year (2023) when SARS started sending me penalties and charging me every month for non-compliance.
I started calling in for assistance and was told that I needed to submit my 2015 tax returns. Not a single consultant was able to assist me with submitting these over the phone, so I eventually scheduled an appointment to visit the Randburg branch.I spent my entire day at SARS that day while officials tried to diagnose the issue. I was finally advised that my x-employer from 2014, had submitted an incorrect Tax Certificate under my profile for the 2*** tax year period. They further advised that there was nothing they could do on their side to remedy the situation, and that I should begin the hunt for my x-employer of 2014, and ask them to submit the correct certificate under my profile.I simply do not understand why SARS waited 10years before picking this error up and only bringing it to my attention now. Surely had I known at least by latest 2016, it would’ve been excusable.Secondly, why am I being penalized for an error that was done by my previous employer of 10 years ago? Why are these penalties directed to me and not the employer who made the supposed error?I’ve tried numerous times to reach out to the x-employer to rectify this, with no luck. I would like SARS to start looking into a better solution for me please. I have since paid more than R2500 worth of penalties and still owing money that I simply do not have. This has taken a tall on my finances and in my life general due to the stress and harassment. SARS should start harassing the employer instead, and penalizing them since the error came from their side.
