Refund by SARS

Formal Complaint: ******** Withholding of R19,000 Refund by SARS I hereby lodge a formal complaint against the South African Revenue Service (SARS) regarding the withholding of my tax refund in the amount of R19,000. I have comp**** fully with all statutory requirements, submitted accurate returns, and provided all supporting documentation within the prescribed timelines. Despite this, SARS has unilaterally deducted funds that are lawfully due to me, without providing a valid or transparent justification. The deduction appears to relate to an interest or adjustment calculation that is neither clearly explained nor supported by the facts presented in my tax assessment. I dispute the legality and correctness of this deduction, as SARS has failed to demonstrate:

The basis on which the R19,000 deduction was calculated; Any lawful grounds under the Tax Administration Act for withholding my refund; Evidence that the alleged interest or adjustments are correctly app**** and valid.

I am formally requesting:

A full and itemised breakdown of the calculation resulting in the R19,000 deduction; Copies of any supporting records or assessments re**** upon by SARS; An urgent review of my assessment and reversal of any incorrect, ********, or improperly app**** charges; Immediate release of my refund should no lawful grounds exist for SARS to retain it.

This matter has caused material financial prejudice to me, and SARS’ failure to provide transparency or justification is unacceptable. I reserve all rights available to me under the Tax Administration Act, including escalation to the Tax Ombud should this issue remain unresolved. S Gounden
