Deceased Estate Tax Refunds

As executor of my late sisters estate, I had to do her tax return and was given the runaround SARS call center agents not knowing their job. This took many months. First told transfer eFilling into my control which was eventually done but immediately canceled. Eventual I was told to make an appointment as they had to do manually for deceased estates. Eventually the income tax return ITA34 was completed with a indicated refund. SARS is not paying because under audit which can take 30 days to year, this is their excuse to delay or not pay. My lawyer has said she has not gotten any refunds for over 2 years for any of the deceased estates worked on. The refund will have to written off as we cannot wait indefinably for a SARS payment to wind up the estate.

When you owe SARS tax, they are on your case, threaten and charge penalties per month, but when they owe a refund, there is no urgency or will not pay and there is nothing you can do about it.
