WORST INSURER EVER!
After a Santam Client drove into me FROM THE BUS LANE ON THE OPPOSITE SIDE OF THE ROAD, GOING THE WRONG WAY AND SKIPPING A ROBOT, they have now decided that it apparently was my fault for not looking! ***! And this after dealing with their run-arounds and shuffling between agents for months! Santam, you suck!
Good day Helen,
Thank you for your post above. We can truly understand your unhappiness and frustration in regard to the process and decision made by our legal branch.
Unfortunately we do have conflicting versions of what happened, from our insured as well as from yourself. From the description of our insured, he was travelling in the same direction as you, although in the bus lane, yes, an the bus lane robot was green at the time, whilst it was red for the other lanes, as you mention in your description. He was not travelling on the opposite side and skipping a robot, as stated by you. His version differs from yours.
Based on these conflicting versions we will not be able to assist and proceed with your claim, unless you can proof our client was negligent and the cause of the accident, by means of providing us with either CCTV footage of the accident or independent witness statements who saw the accident and can corroborate your version of events.
If you do have insurance on the vehicle, we would suggest you claim against your own policy and then the two insurers can liaise regarding liability.
We trust you find this in order.
Kind regards

Good day Helen,
Thank you for your post above. We can understand that you are unhappy with the process and decision made by our legal branch.
We have conflicting versions of what transpired, from our insured and from yourself. Our insured stated that he was travelling in the same direction as you, although in the bus lane, but not on the opposite side of the road going the wrong way, as indicated by you.
The robot in the bus lane was green so he proceeded to cross the lane. As you have indicated in your description of events, the robot was red for you at the time as you wanted to turn right across the bus lane into Trouw Street, when you collided with our insured's vehcile.
Unfortunately based on the conflicting versions we would not be able to accommodate and proceed with your claim. If you can proof that our client was the negligent party then you will have to provide us with either CCTV footage of the accident or independent eyewitness statements to corroborate your version of events.
We trust you find this in order?
Thank you and kind regards.

Dear Helen,
Thank you for your post.
I do understand your frustration. Unfortunately third party claims are dealt with and based on legal principles and case law and although I agree that it is a traffic offense by our insured driving in the bus lane, it still doesn't make him the more negligent party.
We note you have approached an attorney and also included Santam's CEO in the email you sent. These complaints are also dealt with in our office by a specific manager who will also liaise with our legal department on the merits and provide you with the necessary feedback.
As mentioned previously, if you do have any footage or witness statement you can provide us with to proof your case against our insured, please provide us with same.
Thank you and kind regards.
