UNJUST DECISION ON CLAIM

On 31 Dec 2014, Santam's client reversed into the back door of my son's old Citroen DS20 and immediately jumped out, apologised and took responsibility.
The insured claimed from Santam. Finally received feedback on 6 March to say- in Santam's OPINION, both drivers are at fault and should each take responsibility.
Decisions should be made on FACT and not OPINION.
HERE ARE THE FACTS:-
1. My son reversed and stopped to turn the wheel (no power steering)
2. The INSURER reversed into my son's car
3. The damage on the back door is consistent with a vehicle reversing into a stationary car-not a car that was moving perpendicular to the insured
4. My son has four witnesses in the car who can testify that the car was stationary and the insured took IMMEDIATE responsibility for the accident.
6. My son has another six witnesses that witnessed the insured's reaction.
7. The insureds report to Santam states he saw no one and no cars behind him-which is how accidents happen - you don't see!
8. The insured has ticked the box NO when asked if the driver(being the insured) was SOBER

SANTAM is trying to get out of paying a valid case. For youngsters to be treated so UNJUSTLY is disheartening!
