Unfair rejection of a claim
Hi,
I was insured with Santam for a motor vehicle from 1 Aug 2017 and on the 19 Aug 2017 I had an accident quoted to be R214 000. I made a claim with Santam and they rejected my claim on the basis according to them that 1) I was under the influence of alcohol at the time of the accident 2) I did not provide truthful information. At the time of the accident there was no one else involved and SAPS was never on the scene and no breathalyzer or blood was taken from me for alcohol testing. Santam made the assumption of alcohol use on my side based on the tow truck driver who claimed I was intoxicated. I find this very unfair in that no one can conclude alcohol when there was no test done at all to rectify their claim. Relying on the tow truck driver is also not good enough as he is not qualified whatsoever to make such conclusions hence that’s unfair.
I had worked an extended shift (over 24 hrs) prior to the accident and I could not recall exactly my exact whereabouts and exact times prior to the accident hence why there may have been discrepancies in details I gave them.
Shortly after making the claim, Santam did approve my claim and the panel beater started making repairs (ordering parts) but then they later stopped after Santam realized they made a mistake in Authorizing repairs. That is negligence!
They gave me a rejection letter when they had not finalized processing my claim and they told me that the rejection letter was send by mistake.
The grounds of rejection of my claim are totally unfair and the level of incompetence in handling my claim has shocked and caused so much inconvenience on my part.
I wouldn’t recommend this company to any one.

Unfortunately we would not be able to accommodate your request and assist you in this regard on this platform. We note you have already approached the office of the Ombudsman last year -- reference number H337/17H --- and have they ruled in favour of the insurer, Santam.
The Ombudsman is the highest authority in the country in regards to complaints resolution so we would recommend you approach them again should you not be satisfied or have any new evidence to present.
