unfair judgement Santam ***

I type this with utter disgust for this insurance company... I have my employee at my desk in tears as he was involved in a car accident 17/11/2017 . A lady did not stop at a intersection and drove directly into him while he was driving at the speed limit on a busy randburg road. He has an eye witness and the lady driver who drove into him wrote an affidavit at Randburg police station taking full responsibility for the accident . Once my employee put in his claim, it was judged that he was 40% liable for the accident so his damages will not be covered.... So basically he was supposed to see someone using his spider senses not stop at at stop street and hit his vehicle side on.... Santam is taking advantage of my employee as they feel he will not be able to stand up to this and will not be able to fight this.. They used a case from 1975 as reference to their judgement... My name is Glen i have been a financial advisor for over 9 years I now manage a car dealership with over 300 cars in stock i have a good appreciation of the law and the Insurance industry, I also know how to follow all the processes and procedures to take this up with the ombudsman and we can afford legal council. I am giving Santam 48hrs to relook at this case failing which we will persuing further action. My employee had to already pay R10000.00 for his vehicle to be removed from the salvage yard and now has to pay expenses which should have been covered. We will going to court to get all this money back plus our legal expenses....

Kindly advise if your employee has given his/her consent for you to act on their behalf as we will only be able to communicate and correspond once we have that confirmation.

We will liaise with the legal branch who attended to this claim and will revert once we have received the necessary feedback. Kindly note that third party claims are handled completely different to if you would have claimed directly from your insurer -- there are no contractual agreement in place and the basis of these claims is that they are dealt with based on legal principles, case law and the principles of delict.
