THIRD PARTY CLAIM!!!!!!!!!!

I have submitted all documents to your legal department on 6th of July 2023 for a motor vehicle accident as your client is at fault. Even admitted to being wrong and agreed that he will get SANTAM insurance to cover the cost. Your client has had me running around. When I finally managed to get his claim reference. I made a call to your legal department as I received no confirmation or acknowledgment of my THIRD PARTY CLAIM!!!!!!!! It’s pathetic that I need to contact your legal department and no contact has been made to me. I spoke to a person by the name of Anton on the 10th of July 2023 at around 11:30 who then tells me that it’s still under investigation and doesn’t know how long it will take or whether it will be paid out in full for both parties. Even after speaking to Anton from SANTAM legal, I have yet to have received any contact. My insurance has been informed of this matter and that we are not claiming from our insurance. Your client has advised me that SANTAM will cover this. So please, show some empathy to third party claims. I am taking out time in my day and making calls to your department. I do not have to hear this utter nonsense from your legal department as though I was at fault, your staff member Anton even stated as I quote “I need to look out for my clients best interest”. This is after me advising Anton that your client is at fault and even admitted to it. I expect this matter to be resolved as soon as possible and to be contacts with feedback!!!!!!

Unfortunately I am not happy with the response I received. I am told that there’s a contradictory of the events that transpired. If this was the case, your client and myself should have been contacted to further explain the events or contacted via a telephone together. Your client knocked into me. It’s impossible to get the same story or diagram of both parties to reflect the same incident. If there was any discrepancy, we both should have been contacted. BUT cause I am the third party, your legal team is more focused on your client. I am not happy with this. I should not have to bring this to social media as your customer service is pathetic!!!! Also I was told in order for these events to be verified , I need witnesses. This was not specific we when submitting all documents required. I have reported this case when the incident happened and I am not sure if your client did as well. I should not have to be running around like this or going through all this trouble to get my vehicle fixed when your client knocked into me and admitted he was at fault. Doesn’t mean that I am a third party, that your client is automatically right. I expect feedback as soon as possible!

Good day sir,

Your response is noted.
You as third party is making a claim against our insured holding them liable for the damage caused to your vehicle.
Thus the burden of proof is on you to proof our insured was the negligent party and in doing so we are requesting witness statements to corroborate your version of events.

This is standard practice where it comes to third party claims.
Our office cannot assist in this instance and do not get involved when it comes to the merits of a case.

Upon receipt of the information requested our legal team will proceed.
Alternatively you may seek legal advice as well.

So in other words, you’re telling me even if your client admits to being at fault. I still require a witness statement? Then this should be stated on your forms. Cause what was asked was a case number from the police station, ID, drivers license, photographs of the car inside and outside and quotes. So again it’s very convenient that no one from your pathetic establishment has even bothered to contact me. But as I will reiterate, this is only happening cause your concern is more on your client. I work in the service industry and I can reassure this is not what you call service or justice!

So if witness statements are required as your *********** “LEGAL TEAM” stated. How is your client right in this claim without any statement? Let me guess? Cause your client pays you a monthly subscription and I’m not with your company? Cause if this is the case, then both parties should provide statements.

You are claiming against our client's policy holding him liable for the damage to your vehicle thus the onus or burden of proof is on you to provide required information to prove your claim.
