TERRIBLE SERVICE Insurance 3rd party claim SANTAM / LIBRA BROKERS / BENHAUL TRANSPORT
<p>I was involved in an accident on the 16th May 2016 at 11:45am at the intersection of William Nicol & Sandton Drive in Sandton. The company (Benhaul Transport) whose elderly driver (MA Molala ID No. 02/ ********** 682081, Hyundai H100 White, MBN545GP) crashed into me then informed the tow truck driver, who was stationed at the intersection, that he could not read or write and asked if could write down details for the both of us. He admitted to it being his fault and was very apologetic. The vehicles did not need to be towed away so we both headed off. </p> <p>I then proceeded to contact Benhaul Transport to report the accident and spoke to Carol Snydert who then instructed me to contact their insurance brokers Libra.</p> <p>After speaking Eileen Hatting at Libra Brokers I then headed to Roodepoort police station to report the accident only to be told to report it at Sandton police station which I did early evening that same day and was given the following Accident Report No. AR 406/05/2016.</p> <p>On the 27th May 2016 Eileen Hatting from Libra Brokers contacted me via email telling me to contact Santam Legal if they have not yet contacted me and supp**** me with a claim reference number (Ref. ********** 65). </p> <p>31th May 2016 I received an email from Mogamat Marlie a claims handler for liability third part claims at Santam requesting me to send the following along with 2 different quotes:</p> <p>• Vehicle Registration Certificate (RC1) as proof of ownership , if there is finance outstanding then obtain a copy of the RC1 from the bank.<br /> • Photographs, showing the damaged area of the vehicle; (see attached);<br /> • Proof of bank account of the owner of the vehicle (cancelled cheque or stamped bank statement)</p> <p> </p> <p>After acquiring all the necessary documentation and quotes required and sending it off I received an email from the claims handler, Mogamat Marlie, acknowledging receipt of the third party documents and photos. He also informed me that Janice Jones would be the legal officer handling this matter.</p> <p>I then received a mail on the 22th June 2016 from Janice Jones stating the following:</p> <p>"After careful consideration of all the facts surrounding the incident, it would appear that our client was not the cause of the accident.</p> <p>As per my client , you vehicle changed lanes on the turn in front of my clients vehicle, causing the collision. You are therefore the cause of your own misfortune, which my client cannot me held liable for."</p> <p>Please note that during this period I have had to sign a waiver for my Insurance stating that I am not claiming through them as the accident is not my fault but BENHAUL TRANSPORT is at fault and they have admitted this.</p> <p>How can SANTAM/LIBRA refuse to pay out on this claim – do I now have to go to the police station to lay a charge against SANTAM/LIBRA/BENHAUL TRANSPORT or seek Legal Advice regarding this claim.</p> <p>It looks like as a law abiding citizen we are being ********** by the likes of SANTAM/LIBRA/BENHAUL TRANSPORT.</p>

I am writing this comment on Hello Peter in the hope that a person with authority at Santam can respond comprehensively the reason why the following claim was reject by Santam!!
Claim No ********** 65
1. A Hyundai H100 (Reg No MBN535GP) owned by Benhaul Transport collided with my vehicle (Reg No DM22NDGP) on 17/05/16 at 11:45am
2. This occurred at the corner of Sandton Drive & William Nicol Drive (Sandton)
3. Based at the intersection of accident scene was a Tow Truck Driver from Company First Group.
4. The Driver of the Tow Truck – Wilson Mohomve, ID Number & Cell No supp**** to Santam, was a witness to this accident and he has supp**** an affidavit to this effect.
5. The Driver of the Truck owned by Benhaul stated that he cannot read or write and the Driver of the Tow Truck, Wilson Mohomve, assisted by writing down all his details on his behalf.
6. At this stage the Driver of the truck owned by Benhaul Transport admitted that he was at fault – this was done in the presence of the Tow Truck Driver and myself.
7. I then personally contacted Carol Snydert at Benhaul Transport to report this accident
8. Carol Snydert told me that I need to contact Eileen Hatting from Libra Insurance Brokers
9. Eileen Hatting then informed me that this would be a 3rd Party Claim and that SANTAM will be dealing with claim
10. I was then told that I had to waiver any claim to my Insurance as I was not at fault and this would be a 3rd party claim through Benhauls Insurance.
11. On the 27/05/2016 I was contacted by Eileen Hatting via email instructing me to contact Santam Legal with the claim no. ********** 65 if they had not already contacted me.
12. I then contacted Mogamat Marlie (Claims Handler: Liability Third Party Claims) at Santam who advised me the procedure I had to go through and all the necessary documentation along with 2 quotes from panel beaters that he needed to proceed with the claim.
13. On acquiring and submitting all the documentation and photos to Mogamat Marlie I received an email acknowledging receipt on 09/06/2016 and that an assessor had been appointed. The email also stated that this claim would be escalated to a legal officer Janice Jones.
14. On the 22/06/2016 I received an email from Janice Jones with a letter attachment informing me that the claim would not be honoured as the driver for Benhaul Transport shifted the blame my way saying I was cause of the accident. She also suggested that I register a claim with my insurer after already wavering a claim with my insurance for this accident.
15. Unfairly treated I decided to post the entire incident on HelloPeter on the 27/06/2016
16. I was promptly contacted via email by Kurt Roland Koopman (Santam Client Care Manager) stating the following:
“Thank you for referring your complaint and allowing us the opportunity to investigate your concerns.
We investigated your complaint and regret to inform that we remain by our decision not to honour your claim.
Regarding the merits, Santam is faced with two conflicting versions. Our driver, as per his instruction to us, indicates that you changed lanes, knocking into his truck and we can unfortunately not entertain your claim without any independent witnesses.
We followed up with the towing company in an attempt to establish an independent account of the merits around the accident and they informed us they cannot recall the accident.
We therefore remain by our decision and we are unable to assist you any further.”
17. After then contacting Kurt Koopman telephonically he informed me that the claim would be honoured if I was to get a sworn affidavit from the tow truck driver on the scene. Tracking down Mr Wilson Mohomve, the First Group tow truck driver, he recalled the accident and immediately headed to Randburg Police Station to write out a sworn affidavit.
18. I then scanned and attached the affidavit on the 01/07/2016 with an email stating the following:
“I would like to enquire as to which towing company you followed up with? As I went through great effort to find the exact company and driver that was on the scene of the accident. I have tracked him down and he was kind enough to write out a sworn affidavit (attached above) attesting to your driver being in the wrong. We both find it quite curious that the driver states that I was in the wrong, when on the day he clearly admitted to the fault and apologised.
The tow company could not recall the accident as the vehicles did not need to be towed away however I managed to track down the First Group tow truck driver via his licence plate that I acquired going through the images I took at the scene (attached above).
As I’m sure you will now agree that your driver was in the wrong and I look forward to hearing from you with regards to the settlement of this claim.”
19. On the 20/07/2016 I then received this email from Anton Theart (Santam Claim Manager: Uninsured Liabilities) :
“W.O.P. OR ADMISSION OF LIABILITY
Good day Kyle,
We refer to above matter.
After investigating all the information in said matter, will we remain with repudiating your claim, as per our previous letter of repudiation, which we attach again.
We will still humbly suggest that you register a claim with your insurer, who will deal with this matter on your behalf.
We hope this to be in order and can you feel free to discuss this with writer telephonically, should you wish to do so.
All actions will be vehemently defended.”
I therefore now require comprehensive results of Santams’ investigation report on this claim ASAP.
