Stephan Olivier (Santam) - Please clarify

Dear Stephan. Please clarify the following once and for all so that all Santam clients know exactly where they stand. OK, one needs to pay the excess amount as stipulated in one's policy upfront when lodging a claim. Now, If one is involved in an accident or your vehicle gets bumped and as a Santam client one is not the guilty party, then Santam should recover the costs from the guilty party's insurance and the excess payment should be repaid to the Santam policy owner in full. Is my assumption correct ? If so how long should it take Santam to affect the re-payment ?

We hereby acknowledge receipt of your posting above.

You, as a policy holder, are liable by your contract with the insurer to pay an excess if stipulated on your policy. You carry the first amount payable on each and every claim for a specific event, depending on what is reflected and stated in your policy.

If one has an accident and your vehicle needs to be repaired, the repairer may request the excess payment upfront or after repairers had been affected. Our policy does not stipulate when the excess payment is payable and should also not be seen as justification for the satisfactory repairs done. As policy holder you are liable to pay that regardless.

Once a third party is involved our legal department will deal with that and determine the merits of each case. If the other party is the guilty party and Santam can succesfully recover the costs incurred on the claim, meaning the full repaircosts paid to the repairer, then we will refund your excess to you. There are however many variations and legal principles that need to be adhered too and sometimes these recoveries is not succesfull or can take up to three years.
