SANTAM WORMS ITS WAY OUT OF 3RD. PARTY INSURANCE CLAIM / STATES THEIR INSUREE NOT NEGLIGENT

Insurance claim against a driver insured by SANTAM, who admitted it was his fault when he CROSSED INTO OUR LANE and smashed into the drivers side of our vehicle. Our driver was delivering eggs at 5.30am in Port Elizabeth, as he came off the N2 highway onto the M4, it is not a yield it becomes its own lane! A van driven by a gentleman crossed into our lane, and smashed into the side of our bakkie by the front wheel, he panics, slams on his breaks and damaged the whole side of the bakkie, doing around R17,000 worth of damage to the vehicle, he stopped his vehicle and admitted it was his fault he did not see our vehicle. We do have insurance but a large excess so decided to go straight through his insurance, we didn't see a problem. What fools we were!!! We have been dealing with Maurisha Pikaan in the legal department of Santam case no.. ********** 93, and according to her, the driver of the van had a blow out in his rear tyre and because of that was not negligent when he caused the accident! SO THEY ARE NOT PAYING FOR OUR DAMAGE, which their driver did to our vehicle! I asked for the professional report on the tyre, ie; A PUNCTURE< A BLOW OUT< TREAD< OR ACCIDENT CAUSED BLOWOUT? I was told by Ms Pikaan that it was privileged information! How can they get away with that when the condition of the tyre hinges on whether they pay or not. We will see what the insurance Ombudsman has to say! A solicitor friend has offered to take on the case but we will be suing the driver of the other vehicle!
