SANTAM DPC Legal/staff's shocking service re third party claim
A client of Santam reversed into the back of my vehicle last year 2017.We were both parked alongside one another.I reversed first - I was on the client's left hand (passenger) side. Once I reversed & was about to turn to drive behind the other party to exit, I noticed that she had just started reversing. I hooted loudly to warn her that I was still behind her but she continued to reverse & reversed into me (my vehicle's front right side). I could do nothing to avoid the situation as I had a fence behind me. The damage is R15 000. After exhausting trying to go through the other party's insurance as a normal claim, I decided to pursue a third party claim in good faith - all required documents & quotes were submitted about 20 November 2017. Having reviewed Santam's third party claim information online I was confident that it would be a seamless process. Well was I wrong! I first heard from Lerato Ramela/DPC Legal, handling the case, on 28 January 2018 to say they were assessing the incident.On the 30 January I received another email from Santam DPC Legal/ Lerato with a settlement letter attached - informing me that it was both our faults & thus no settlement would be due to me (subsequently I found out from the client that she had submitted her claim to Santam & her damages had been paid for).On 2 February I submitted a succinct email to Lerato/ DPC legal detailing why it was impossible for both of us to be responsible & how it could only be Santam's client that was 100% at fault - I reversed first & she should have waited until I had passed behind her (basic Leaners & Drivers 101) especially since we were parked alongside each other, when I hooted loudly she took no notice & continued to reverse, I could take no avoidance action as a fence was behind me, she admitted afterwards that she could not see well outside her SUV (it was dusk, SUV has dark windows, 3 dogs in back, smaller rear screen than standard vehicle & she wears thick glasses). I have to date received no response from either Lerato or DPC Legal!! Not even an acknowledgment of the appeal email sent! Just ignored!!! I have since approached Santam's client & appealed to her sense of reasonableness/fairness to inform Santam of exactly what happened & that she admitted fault subsequent to the accident & had apologised to me. I have witnesses who were present at that meeting who heard her say I was in her blind spot & that's why she has insurance.She did write Santam DPC legal/Lerato an email but reiterated her false story (I believe) although she did inform them in her email that I was in her blind spot. Santam's DPC Legal/Lerato obviously CHOSE to overlook that major admission & still have not responded!!Logic dictates that if I was in her blind spot why did she attempt to reverse as reasonable person would wait until I had gone from behind her before reversing)!!! She also claimed that we reversed simultaneously which is impossible, again logic dictates that I would have been hit on my vehicle's side rather than at the top right of my vehicle. It is obvious that Santam has CHOSEN not apply their minds ( a settlement letter in less than 2 days after first telling me they had received my claim & were working on it?) All I can say is that Santam was duped by their client & paid her claim according to her account (there were no witnesses) &now they do not want to pay out my claim although it is 100% not my fault. Why did Santam contact me to get a full account of what transpired & if necessary clarify anything that didn't quite make sense!? The inconvenience & frustration I have been subjected to is very inconsiderate. The shockingly slow process/*********** employees has left me continuously following up on them to no avail - I am still ignored.!!Very disappointing - I thought I was dealing with a reputable company. REALLY UNACCEPTABLE!!!!
