Santam are ****mers and want me to commit *****

On the 22nd of September 2024, my vehicle was hit from the back while I was waiting for my right of way at a traffic light junction. The traffic lights were not working on the day, so obviously the junction is used as a four ways stop, since there were no officers controlling the traffic.

I was travelling with my 3 years old daughter and the gentleman that hit my vehicle from the back was travelling alone in the car. I switched off my engine and 1st checked if my daughter was not harmed in the impacted and then proceeded to check the damage of the car. I took images of the accident and called JMPD to the scene. MR Van Wyk,( Santam Client) started apologizing and saying that he was not focusing on the road or was distracted and didn’t notice that my car was waiting for its right of way to cross over.

JMPD arrived and took both our statements where Mr Van Wyk repeated the statement to the officer. We exchanged contact numbers and said that we will be in touch as to how to resolve this matter. We kept communication until Mr Van Wyk referred me to his broker that will be assisting in submitting a claim for t the damages on my vehicle. I submitted all that was required from my side by the broker. Then I was referred to Mr Nazeem Jacobs ( Santam Claims Consultant) as the consultant that will be handling my claim. This has been 2 months of constant phone calls and emails with no clear indication of when will this claim be resolved. It was only recent about a week ago that Mr Nazeen emailed me stating that my claim will not be processed unless if I provide a written statement from a witness that can support my explanation of how the accident occurred. I asked Nazeem as to why am I required to do so and his answer what that Mr Van Wyk claimed that I reversed my vehicle and that’s what caused the accident. I further asked if Mr Van Wyk had a witness to support his statement as he was travelling alone in his car. There was no response.

I explained to Nazeem that I was with my toddler in the car and there is no way that she would be able to give evidence of what happened. Nazeem stated that without a statement from a witness, my claim will not be entertained.

To my understanding Mr Van Wyk( your client) his vehicle has been repaired and was not required to get a witness statement. I have been emailing and calling numerous times to try and get an understanding of how am I suppose to get a witness that was either a bystander, someone driving by 2 months later. And shouldn’t the accident report from the JMPD be enough evidence because we gave the officers our statement at the same time and at no particular point did Mr Van Wyk say that I was reversing my vehicle. He kept the same statement from the begin until suddenly he changed.

So does Santam want me to fabricate a witness and statement so they can turn around and say I am committing *****? Why didn’t they request a witness from their client but I am being treated like this when I am the one at a loss. My vehicle is still damaged and they don’t want to take responsibilities or accountability for the damages. I have escalated the matter to Nazeem Jacob’s supervisor and till this date I haven’t received an update as to how this matter will be resolved
