Santam 3rd party claim -RIDICULOUS
<p>On the 27 March 2017 I wrote to hello peter about a 3rd party claim Santam does not want to settle.Today I got a mail from Santam with the ridiculous settlement of a R5 017.The amount that they sould give me is +/- R16 380.My caravan is written of,how do I replace or even try to repair my caravan with R5 017???A BMW 320D (E90) ovetook me on a white line while I already turned into the road I wanted to turn in.The BMW hit me 1st from right side behind and then slid trough on my right hand side ,damaging my caravan and Isuzu 300TDI.As far as the law, it is the driver that hits you from behind's fault.Mr.Mongamele said in his mail to me"Our insured was already in the process of overtaking.thus you(Me) still owed a duty of care towards the overtaking motorist in by simply checking your blind spots you could have avoided the accident".Ok 1st of all I aready turned ,the Isuzu was already turned in the way I was turning when he,the insured hit me from behind.2nd There was a white line and the BMW could not overtake me there.Seems like Santam is telling there clients that it the right thing to overtake on a white line,don't worry the person you are overtaking sould look out for you?????Mongamele is telling me that I sould look out for a person overtaking on a white line from behind????Mongemele is stating that this accident could have been avoided by me .There insured overtook me on a white line.Mongamele is telling me that is sould have looked before turning"I already turned".Seems like Santam client have right of way when using a public road,all the other persons on the road sould look out and think for Santan clients.The insured who hit me from behind sould also have a look before overtaking on a white line.Seems like white lines on the road does not apply to Santam clients and the dont have to look out for other road users.I don't know how he, Monamele could tell me that I sould look out and that it is ok for the insured to overtake me where he did????????????Please assist me in this matter.</p>
