Santam 3rd Party Claim

I recently was in a car accident...was not my fault....so 3rd party claim. But they made me the person who could have avoided the accident...idf someone skip a stop sign. How do you avoid that. They made it that I paid penalty for someone elses mistake....my car is writeoff and have no transport of my own...cannot afford another vehicle at this moment
