Ridiculous offer on third party
I got into an accident with a driver on the 3rd january 2020(Field marketer) from kmartk pty ltd, the guy immediately admitted to swerving and colliding with my car and made a police statement before i was taken to hospital admitting that he lost control and collided with my car which was on the oncoming lane, he then gave me a number for the company he is working for, where i was advised to lodge a claim with their insurer -SANTAM with caim no***, they first requested 3 quotes for a car that is not drivable , when that was sorted out , they assess my car and wrote it off.
Now the most ridiculous thing happens, when i received an offer from Julia Mogase offering me R31 054.50 for a car with a retail value of R127 000.00, stating that i should have slowed down when i saw there was a car swerving to my direction, i should have hooted and i should have moved to the left ,and they offered me a settlement based on the assumption that i did not do those things which was completely ridiculous because not once was i asked what did i do when i saw the was a car swerving to my lane, not once did they consider that their client was not changing the lane intentionally but he lost control , so even on his side the move was not calculated,not once did the considered the speed their client was driving at 70-80 on a urban area with a speed limit of 60. They referenced my claim to a case of a car that overtook a stationery bakkie and collided with on coming s****** that had space to move to the left on a gravel road, not considering the size of a s****** and a car on a tar road with a pavement on the side and a bus stop just after the accident spot (have pictures to show the pavement and where the bus stop start and the effect after the accident), i rejected their offer telling them the case is not the same as mine, they can't use it as reference and how do they know i did not do the things they stated and deducted 70% for, Julia Mogase then came back stating only 1 reason(still worth 70%) now that there was a bus stop on the left i should moved to the left, ohhh and i forgot they evaluated the condition of my car and their assessor said the condition is good but they still deducted 10% for condition and mileage and 30% for Salvage as if i'm in the business of selling s**** cars
I'm still shocked the FSB allows this company to trade as an insurance company in SA with so many negative reviews from dissatisfied customers and robbing their clients of the third party service which they actually pay for in circumstances where they are the cause of an accident.
