rejecting to pay my car after driver confessed that his brakes failed to stop

reya vaya bus bumper my car 06/01/2021 up until today when received a call from 1 of their employees telling that they mid reject the claim as they do not have enough evidence but their driver confess to me and other people that his brakes failed when he was supposed to stop and and he saying he had right of way and the robot was was red for him he also mentioned it on his report i do not have a lawyer or afford to pay insurance for my can please be assisted
