Old Damages

It is very sad to realize that I had to pay twice for old damages as referred to by Santam's assessor. In May I had an accident and the vehicle was a right off was told it was uneconomical to repair. I Opted for a 50% buy back. I was charged R4500 for old damages and now may car had to be fixed, the invoice also quoted same old damages. So all in all I have paid twice for the same damages.

Why am I been charged for old damages if I am keeping the car? I would understand if the Insurance had settled me in full and kept the vehicle. This was a buy back.

As per below email from Johann.
The damages I am deducting does not have anything to do with the previous claim.
We had a re-look at the old damages and decided to deduct then only R4500.
Then settlement will be :
R37700 les x/6 and insured can keep the vehicle.

Can someone please explain. According to legal representative I was not Allowed to be charged for old damages if I am keeping the car. And besides this was never communicated with me on inception. I would understand if this was communicated when I took out this cover .

Your urgent response will be appreciated.
