Motor accident claim
<p>Good day, My mother was in a motor car accident on 4 December 2013. She was 82 at the time. All documents from the SAPS were filled as well as all the insurance claim forms. Both vehicles were repaired in due time. The two insurers are: Santam (for my mother) and BSG (for the other vehicle owner). BSG is claiming an amount of R19 336.00 from Santam as my mother was the wrong doing party in the accident. Santam did not attempt to resolve this claim (according to documentation I have). An e-mail from BSG with all relevant documents was sent on 26 August 2016 to claim mentioned amount to a certain Mr Welcome Mo***eng (011- ********** )(Letter of demand). The only response from Mr Mo***eng was an e-mail requesting the relevant documentation on 7 October 2016. My sister was on the phone for a few weeks to try and sort this out as a summons was to be submitted against my mother for non-payment. I talked to BSG on Thursday 16 February 2017 and the lady (Llenechca van Wyk) assured me she asked her legal department to delay the summons until we can clarify the matter. I also phoned Mr Mo***eng but he was not in his office, I was put through to Anita (I assume she is the manager's personal assistant. Manager: Mr Nolan Nair). She phoned me back with the news that the claim already lapsed (three years after the accident on 4 December 2016) and no claim/summons can be issued. I still want to know why Santam didn't attend to the matter in due time. The summons is still to be served in no time and I want to try and stop that.
