Legal team assessor - Daniel Buitendag threatens and degrades claimant to accept unfair offer on 3rd party claim!
I have a 3rd party claim pending with Santam, my vehicle was rear ended by Ndaba funeral services in PTA on the 20/08/2017, we have had nothing but back and forth issues pertaining to the paperwork, finally on the 17/10/2017 the matter was appointed to Phakamile Sedia at Santam,. Yesterday, Mr. Daniel Buitendag ( ********** 172) called the owner from Approved panel beaters and made an offer of R14000 to have my vehicle fixed, the owner advised Mr. Buitendag that he would need to speak to me first as an offer of R14000 was unacceptable. Then, yesterday at approximately 14:30, Mr. Buitendag called the owner of D All Round Panel Beaters and he proceeded to attempt to negotiate with him on the cost involved to fix my vehicle, he made an offer of R13500, when the owner of the D All round panel beaters advised him that he would need to speak to me first as I am the owner of the vehicle, Mr. Buitendag proceeded to tell him that the customer needs to just accept this amount as this is an old vehicle or he will reject the claim, then he said he won’t reject the claim but will rather ask for another quote. He then proceeded to tell the owner of the panel beaters that the customer is full of **** and that they (being the panel beaters) have until yesterday afternoon(25/10/2017) to accept this offer! Needless to say, both panel beaters contacted me and advised me of what had transpired between themselves and this Mr. Daniel Buitendag. Now, let me ask the following questions: • Is it the practice of Santam to have the assessors from their legal department degrade claimants as I was yesterday, I ask this because I want to know how a personal attack on myself is actually relevant in resolving this 3rd party claim? In what capacity does this MR. Buitendag speak on behalf of Santam, I ask this because I want to know why he refers to me as being “full of ****”? Does he own Santam, does he own shares in SANTAM, even if he does, who gave him the right to degrade me in such a manner? Does he know me in a personal capacity that he feels that he can so easily voice his unwanted and unheeded opinions of myself? • Is it the operating policy of employees of SANTAM to basically threaten to reject claims on behalf of SANTAM if customers/claimants do not accept the negotiating offer from the assessor, which by the way is not even fair in any way or manner as your client drove into MY VEHICLE - he rear ended my vehicle, damaged it to such a degree that the boot lid no longer closes or locks, it stays open all of the time, my bumper is practically falling off, it cannot be repaired! I want to know under what rule of law or policy or procedure at SANTAM does Mr. Buitendag have the right to threaten to have my claim rejected if I do not accept these offers? • Also, Mr. Buitendag said that he can supply the parts that are needed to fix my vehicle, he also provided the panel beaters with contact numbers of his said supplier- Grandmark - ********** 550, when we contacted them and asked for the parts, we were advised that they do not have the parts in stock for my vehicle which is a 2001 E46 BMW 330ci Convertible, Grandmark advised us that they in fact do not stock the parts at all, so does SANTAM normally lie to all its claimants in such a manner? Does Santam operate under the norm of manipulating and lying to and degrading its claimants? • Is it the hope of this person, this Mr. D Buitendag that he can brow beat me and degrade me to such a degree that I will just accept any offer and just go away? • Furthermore, this was not a personal matter between Mr. D Buitendag and myself, he made it personal by thrashing me in his conversation with the owner of D All round panel beaters and it was totally uncalled for, it was also overheard by patrons of his establishment as this representative of SANTAM was put on speaker when he called. All that I am trying to do is get my vehicle fixed, he portrays someone who is personally paying for the repairs of my vehicle and his statements are prejudiced. I, as the owner of the vehicle that was damaged by your client, have every right to fair and professional treatment as any other person, I will not tolerate *****ry or bullying in any shape or form!!!!! I will not be bul**** or threatened into accepting any offer of any kind unless I feel that it is fair to me, the ACTUAL owner of the damaged vehicle. I expect this matter to be resolved in a timeous and fair manner.
