Different excuses not to pay out!!!!
My daughter was driving in Benoni on her way to work when another driver skipped a slipway on her left and made an ******* u-turn in front of her. Her did not only turned on a solid line but also over diagonal line as well as at a NO U-TURN sign. Santam now accuses my daughter of the following: the driver of an oncoming or following vehicle has a duty to keep a proper look-out and as soon as it becomes clear that a U-turn is about to be executed, should take all reasonable steps in order to avoid a collision by keeping a proper look-out, reducing speed and by taking avoiding action. Failure to do so, may render such an oncoming or following driver contributory negligent. Therefore pay out 70/30% due to her being negligent...<br> <br> <br> <br> On top of it all the driver at fault acknowledged to the police that he made an ******* u-turn. Please correct me if I am wrong that the driver at fault should be penalized?? His car license has also expired....Which was past his 21 days of leniency to renew the license disc.<br> <br> <br> <br> We are forced to take legal action should this matter not be resolved soon and the claim re looked at.<br> <br>
