Claim access amount back from 3rd party

My granddaughter was involved in an accident early Desember 2022. The third involved was one of Santams preferred provider. The claim for settling went fairly well, although becomes she was under 25 and licence is less than two years old, the access amount was deducted from the settled amount. (See my letter to the Santam legal department belo) Upload of photos and info I have. The case number I will get at 11.00 as this will only be available by then, will forward as soon as I receive this.

Just some details on the accident and the confession by the driver of the "First Help" tow van that was involved.

He was driving up a one way (Rissik Street) , skipping the robot that was red, to get to another accident scene, my granddaughter was travelling on Anderson street and the robot was green for her when this guy skipped the robot..... the driver then got out of his van and said he is sorry, not sure if sorry will fix damage

The statement taken down by the traffic officer said that they will charge him for reckless driving. . I have followed up with them and response is that it can take up to 3 months to get the access amount back from them, this in my mind is not acceptable.
