Bad conduct and lying by Santam

I was involved in an accident with your client Mr. L Swart on the 30th October 2017at 07:10am. Your client Mr. L Swart admitted that he had just come off work, he was tired and did not see me, and was 100% at fault in coursing the accident. On 31 October 2017 I received a phone call from Elmarie Wentzel (SanmacTrust) broker for Mr. L Swart in connection of filing a 3rd party claim for the repairs to my vehicle. I sent Mrs. Wentzel all the document and quotations as requested. On 30 November 2017 I received a Third Party Release ********** 36 from Mrs. Wentzel that was sent to her from Mrs. Julia Mogase (Santam) for a settlement amount of R20 914.01. I signed the Third Party Release and handed it in at the SanmacTrust office in Heidelberg 30 November 2017. The quote from Fix-Em panelbeating was for R30 800.52. I also received the breakdown from Santam assessor Mr. D Buitendag (Assessment Number: DB000132). This assessment was also sent to Fix-Em Panelbeating. They checked their quote and the assessment, sent photos and quotes to Mr. D Buitendag (Sanlam Assessor) they then agreed upon an additional amount of R4 921.27 to be added to the initial assessment of R20 914.01. So the total amount would be R25 835.28. This was sent to Mrs. Julia Mogase per email from Mr. D Buitendag on 1 December 2017. Mrs Wentzel informed me that she would not be sending in the Third Party Release yet as the amount of R20 914.01 would be amended to R25835.28 to include the additional repair cost and I would then receive the new Third Party Release soon, as my claim is covered 100% by Santam. I contacted Mrs. Wentzel on numerous occasions to find out as to when I will be receiving the new Third Party Release with the new amount of R25 835.28, as the panelbeaters and factory to order parts will be closing on 15 December 2017. The only reply Mrs. Wentzel received was that Mrs. Julia Mogase would be sending it soon. On Friday 1 December 2017 I had still not received the new Third Party Release and after consulting with Mrs. Wentzel, that I would send my vehicle in for repair on Monday 4 December 2017 due to the factory’s and panelbeaters are closing on 15 December, and it would not be a problem as I received the Third Party Release for R20 914.01 the addition amount of R4 921.27 will be added to the amount and release sent to me soon. Received my vehicle back from the panelbeaters on 11 December 2017. On 12 December 2017 to my utter shock and dismay I received the new Third Party Release from Mrs. Wentzel and to contact Mrs. Julia Mogase (Santam) directly. The new Third Party Release was now changed to only R11 488.26 and not for R25 835.28. I immediately contacted Mrs. Julia Mogase. On querying the amount with Mrs. Julia Mogase (Santam) she said that I am now being held responsible for 60% of the accident as I did not try and avoid it, even though her client has stated that he is 100% to blame for the accident, and I did everything humanly possible to avoid the accident. When I queried this Mrs. Julia Mogase’s words to me was “ I can do what I want ” Upon querying the first Third Party Release for R20 914.01 sent to me on 30 November 2017 Mrs. Julia Mogase stated that she did not send that one to me, someone els was working on her computer, even though it has Julia Mogase email address and signature on the release. On explaining to Mrs. Julia Mogase what happened in the accident taking place, and questioning on the fact and unorthodox manner that someone els is working on her computer and sending out legal document which aspires to *****e. I requested to speak to Mrs. Julia Mogase’s supervisor. Mrs. Julia Mogase refused to let me speak to her supervisor, instead then offered to pay out the first Third Party Release of R20 914.01 but without the additional R4 921.27. I refused this, as how could Mr. Julia Mogase first send me a Third Party Release covering 100% of my claim realizing that her client is 100% to blame for the accident he caused. Then decide all of a sudden after my vehicle had been sent for repair I am liable for 60% of the cost, then revert back to the first Third Party Release but not the full amount of R25 835.28. I insisted on speaking to Mrs. Julia Mogase’s supervisor. Mrs. Julia Mogase then told me she would speak to her supervisor first and contact me back on 13 December 2017. That did not happen. I then went to see Mrs. Wentzel regarding this matter, whereupon Mrs. Wentzel suggested I send in the first Third Party Release of R20 914.01 and she would see what she can do to get the remaining amount of R4 921.27 next year (2018) as most of the managers are on leave at the moment. I agreed, but with a concern and reservation that once I send in the first Third Party Release and agree to a settlement amount of R20 914.01 that Santam would not payout the remaining R4 921.27. After reading the email of Mr. D Buitendag I feel a bid more confident that Santam do the ethical and correct thing in paying the full claim on behalf of their client. Payment of R20 914.01 was only received 12 January 2018 after I was promised that it would only take 5 working days for the payment to be processed. Currently I am still waiting for the remainder (R4921.27) to be settled or receive any feedback from Santam. On 19 February 2018 as was asked by Mrs Wentzel (SanmacTrust) broker if I would come and see her at her office in Heidelberg so that we could have a conference call with Mr Sydney Ramulongo Santam Branch Manager, to sort out the claim. After a long conversation with Mr Ramulongo explaining the case as stated above Mr Ramulongo informed my that according to Julia Mogase’s notes I apparently accepted the Third Party Release for R20 914.01. This was untrue and requested the telephone voice recording as this will clearly show that I did not accept anything and that I was still waiting for a response from Julia Mogase’s supervisor. I was then informed that there is no voice recording available. My question to Mr Ramaulongo then was, why would Mrs Wentzel (SanmacTrust) and myself pursue this matter for months now if I accepted the offer as final. Mr Ramaulongo could not answer me and for some reason Julia Mogase was not available at the time to clarify the matter. Mr Ramaulongo would get back to me after clarifying the matter. Response received, making me and Mrs Wentzel out to be lying. "I refer to Julia’ mail and attachment of the 01 March 2018 & 12/12/2017. I honestly think that the offer and payment made to Mr Botha is more than reasonable. As indicated to you, the case is subject to apportionment and in order to amicably finalise this matter, Julia and Mr Botha agreed to settle based on the original assessed amount, excluding extras. This was only on condition that apportionment would be waived. I am very convinced that this was indeed an agreement reached between our Ms Julia Mogase and the third party, Mr Botha"
