Sanlam Evasiveness in Share claim process
Formal Complaint Regarding Failure to Directly Communicate with Estate Representatives
Dear [Sanlam Complaints Team],
I am writing to formally lodge a complaint regarding the failure to communicate directly with the designated representatives of my late father’s estate in relation to his unclaimed dividends and shares held in the Sanlam Share Account. Both my mother and I are joint estate representatives, yet the communication concerning the forfeiture of dividends and liquidation of shares was directed solely to my mother, rather than to both of us.
Background of the Issue: Both my mother and I are jointly responsible for managing my father’s estate, and we have both been actively involved in the claims process. As such, we both should have received all relevant information regarding his Sanlam Share Account, including the notification about the forfeiture of dividends and disposal of shares. However, I have only recently become aware that this important communication was sent exclusively to my mother, which is a clear oversight given our joint role as estate representatives.
Specific Concerns: Failure to Notify Both Estate Representatives As both my mother and I are joint representatives of the estate, we should have received equal communication about my father's Sanlam Share Account. The failure to send this communication to both of us is deeply concerning, especially as I am an active participant in managing the estate and claims process. Impact on Estate Claims This lack of communication has delayed our ability to properly manage and address my father's unclaimed dividends and shares, potentially leading to missed opportunities and financial losses for the estate. Request for Documentation I request copies of all correspondence related to my father’s Sanlam Share Account that was sent to my mother. Additionally, I would appreciate a clear explanation as to why I was not included in this communication, despite being a joint estate representative. Request for Resolution: In light of this oversight, I kindly request the following:
An explanation as to why the communication was only sent to my mother and not to both of us, as joint estate representatives. Copies of all communications sent to my mother regarding my father's Sanlam Share Account, including details on the forfeiture of dividends and liquidation of shares. A review of the forfeiture and liquidation process to ensure that no further actions were missed or delayed due to this communication issue. Information on how we can recover any potential losses or missed opportunities caused by this failure to properly notify both estate representatives. I trust that Sanlam will address this matter promptly and provide the necessary documentation and clarification. I look forward to your response and a resolution to this issue.
Thank you for your attention to this matter.
