Complaint: ******** Blocking of My Fund Statement and Prevention of Two‑Pot Withdrawal
I am lodging a formal complaint against Sanlam Employee Benefits regarding the ongoing and unjustified blocking of my fund statement and the obstruction of my Two‑Pot withdrawal. Sanlam issued a letter dated 1 August 2025, stating clearly that the divorce order on file does not comply with section 7(8) of the Divorce Act read with section 37D(4) of the Pension Funds Act. Specifically, your own communication confirms:
The incorrect fund name was cited. The order does not direct the correct fund to make payment.
Due to these defects (requirements 1 and 4), the order cannot be acted upon, and no payment or restriction can legally be imposed on the basis of this invalid order. Yet, despite this explicit determination from Sanlam, my statement remains blocked, and I am unable to proceed with a Two‑Pot withdrawal, which is entirely unrelated to the unenforceable divorce instruction. This continued blockage is:
Procedurally indefensible, Contrary to Sanlam’s own written position, and Prejudicial, as it restricts access for no lawful reason.
