Mercedes Benz Sandton Sold Me A Car Involved in a R350k accident without informing me!

Mercedes Benz Sandton sold me a vehicle that was involved in a R350,000 ACCIDENT WITHOUT TELLING ME!

I bought a CERTIFIED, APPROVED used vehicle from Mercedes Benz Sandton in 2019 for R655,000. The vehicle had approximately 45,000km on the clock.

In 2021 I hit a pothole and the tyre burst. My insurance towed my car to an approved Mercedes Benz vehicle repair shop. It was here that it was discovered that this car was in a major accident an accident so bad that all the airbags had deployed.

I brought this to Mercedes Benz Sandton's attention they chose to jump on the defence and not even try to sit down with me to understand the story, instead, I was given the cold shoulder and little response or communication they were quick in saying how could they be sure the accident wasn't me and they had done all the necessary checks when selling me this car and there were no signs of any accident. They also stated that the car went in for minor repairs and they saw no problems with the vehicle. The dealer principal stated the following "it is however important to note that if the damage was of a very high value, then they would not sell the vehicle through the CPO channel but would rather wholesale it to another retailer to sell"

Now I ask is R350,000 NOT A HIGH VALUE? It is half the value of my car!

I lodged a complaint at MIOSA they ruled against me because at the time I never had sufficient evidence and they believed Mercedes Benz Sandton had done all the checks they needed to do. With that ruling, it has made Mercedes Benz Sandton almost impossible to talk to as they simply say MIOSA has ruled on this and they stick with the ruling even though I had now sent them all the evidence with the pictures and the report on the vehicle.

A simple 72 point check done by another Mercedes branch showed that there were parts in my car that were for a different Mercedes model and not my model? Surely this should have sparked off a red flag with Mercedes Benz Sandton? I went on to find pictures of the accident with time and date stamps on them the accident was in 2018 I bought it in 2019! I saw the insurance companies details in these pictures and contacted them they confirmed this vehicle was in an accident. Now if Mercedes were not aware of the accident I have now made you aware surely you should do anything to try to resolve the issue why is it that your client is suffering?

I have been trying to resolve this issue with Mercedes for almost 1.5 years they have in NO WAY tried to resolve or correct the issue at hand!

This has caused me great stress and anxiety now that I am aware this car was in an accident I have to disclose it to the next buyer which greatly depreciates the value of my sale! WHAT DO I DO?
