SAMSUNG REFUSING COOPERATION AS PER THE CONSUMER PROTECTION ACT
I bough a Note 9 for R 19 000.00 at the end of November 2018. After just two weeks I started having problems with the phone not charging with the charger port! According to the Vodoshop where I bought the phone this is a everyday problem with the note 9, so beware! In order to have my phone working I was forced to buy an extra cordless charger. Its now the 15 of January 2019 and its still not charging with the Samsung charger. It has a battery-live of about two hours. Apparently another note 9 problem... In order to get the phone assessed, (Before its even repaired...) Samsung expects me to drive 240 kilometers to Polokwane to a service center, that according to the local Vodoshop will still have to send the phone for repairs to Johannesburg because Polokwane can not deal with something of this nature, leaving me without a phone for 3 to 4 weeks! Totally Ridiculous, because the law states clearly I am entitled to a replacement or a refund! MY CHOICE!
Terms of the common law and the Consumer Protection Act No 68 of 2008 when you buy damaged or defective goods:
Despite the fact that the Consumer Protection Act No 68 of 2008 (CPA) came into force on the 1st April 2011; which is more than seven years ago now, many businesses and service providers continue to operate outside the legislation and some do so blatantly and knowingly very often duping their customers at the same time so as to save themselves a great deal of money and effort. Some actions reported to us border on ******** *****.
There are also other consumer complaints from our clients including unreasonable terms and conditions in contracts and ***** forms and even attempts to get them to sign indemnity forms.
The law are as follows: (In case Samsung or its employees did not know all ready...)
Consumers have the right to return to the supplier/service provider faulty, damaged or poor quality goods within six (6) months of the date of purchase. It is your right and your choice. It is not up to the dealer!
Do not allow a supplier to hoodwink you and deprive you of your consumer rights.
Suppliers often try to talk you into simply agreeing to them repairing the item as that is their cheapest option, and make out as if they are doing you a huge favour. Do not be duped! It is your choice and your right! All those suppliers that insist on a repair of the item instead of offering you the choice of a refund or a replacement as well as a repair are breaking the law. Those suppliers that also insist on providing you with a credit voucher; instead of your requested cash refund are also breaking the law."
The arrogance of Samsung is staggering. They blatantly brake the law by trying to not engage customer complaints so the six months clause of the law comes into effect!
Please also note all my previous complaints on this forum: Also note that they supply you with a reference number and then do not take any action. They ask you to engage them on social media but refuses to answer or simply block any complaints. Emailing them is of no use as their email address does not allow any incoming messages. A simple fact that the receive to many complaints perhaps?
Phoning their call center is a complete nightmare as you can only engage with low-level employees that has absolutely no decision making power! You are never able to speak to a supervisor that allows one the conclusion that there are not any people at Samsung willing to assist in any way!
SO BEFORE YOU SPEND MONEY ON THE NOTE 9... Make an informed decision. Do not spend your money with a company that decides to trade outside the South African Law. Buy something cheap that you can replace as you are guaranteed problems with the Note 9!!
