Samsung promotions False and Misleading.
My fiancée took out a Vodacom contract in the week of 11 – 17 October. As stipulated by Vodacom and Samsung, the Samsung Galaxy Note20 had a running promotion where you would receive a 32” HD TV.
As such she decided to get the Samsung Galaxy Note20 LTE Mystic Grey and upon receiving the device she proceeded with the steps indicated on the Samsung offer page to claim the 32” HD TV, but the offer was not available in the Samsung Members application under benefits and this is when she contacted Samsung for support. The agent first states the Mystic grey LTE device does not qualify and the link to the offer was shared that indicates the statement “sign up or upgrade to any Galaxy Note20 or Note20 Ultra” as per the Samsung website. She is then told to look at the Note20 Rage, but there is no mention of any specifics in the term and conditions and no mention of what the Note20 range indicates. Referencing the Terms and Conditions you can clearly see that it states the following: “3.1.6 Purchase a Note 20 LTE (SM-N980) or Note 20 5G (SM- N981) or Note 20 Ultra 5G (SM-N986) (“Qualifying Device”), with a valid IMEI number, from an authorised network operator, retail outlet or online within the Republic of South Africa during the Promotion Period.” “4.1.2 Purchase and activate the Samsung Galaxy Note 20 LTE (SM-N980) or Note 20 5G (SM-N981) or Note 20 Ultra 5G (SM-N986), which Qualifying Device must be purchased from”
As you can see the Terms and Conditions does not mention any specifics. There is also no mention of color in the Terms and Conditions. As such she was told to contact *** (With NO response)
In accordance with the Consumer Protection Act | Government Gazette no. 32186 Part D - Right to disclosure and information Product labelling and trade descriptions. (2) A person must not— (a) knowingly apply to any goods a trade description that is likely to mislead the consumer as to any matter imp**** or expressed in that trade description; or (b) alter, deface, cover, remove or obscure a trade description or trade mark app**** to any goods in a manner calculated to mislead consumers.
Part E - Right to fair and responsible marketing General standards for marketing of goods or services 29. Aproducer, importer, distributor, retailer or service provider must not market any goods or services— (a) in a manner that is reasonably likely to imply a false or misleading representation concerning those goods or services, as contemplated in section 41; or (b) in a manner that is misleading, ********** or deceptive in any way, including in respect of— (i) the nature, properties, advantages or uses of the goods or services; (ii) the manner in or conditions on which those goods or services may be supp****; (iii) the price at which the goods may be supp****, or the existence of, or relationship of the price to, any previous price or competitor’s price for comparable or similar goods or services; (iv) the sponsoring of any event; or (v) any other material aspect of the goods or services.
As Samsung states on their website that the purchase of “any” Galaxy Note20 or Note20 Ultra qualifies for the promotion it is not in line with the Consumer Protection Act. The promotion as per the Samsung.com website is false/misleading advertising. Samsung does not respond to emails and have had no correspondence with me since this issue was raised.
