Samsung and Skynet – Breach of Consumer Rights by Failing to Deliver Products
We( my partner and I) purchased a Samsung phone which, as per the advertised package, includes a smar****ch and earbuds. These items form part of the total purchase and were not optional extras.
However, to date, we have not received these items due to Samsung’s use of an unreliable courier, Skynet, who failed to contact us properly for delivery. Today, one of Samsung’s agents(Kisdy) contacted us and informed us that we have “forfeited” the gadgets. This is unacceptable and ********. How can a consumer forfeit something that was paid for and forms part of the purchased product?
Under the Consumer Protection Act (Section 55 & 56), we have the right to receive goods that are as advertised and of the quality and description agreed upon. Samsung, as the supplier, remains legally responsible for delivering the complete package — blaming the courier is not an acceptable excuse.
We demand that Samsung immediately rectifies this breach by ensuring that we receive the smar****ch and earbuds that are part of our purchase, failing which we will escalate this matter further
