False promises made for Returning Security Deposit

Hi There, I hope this gets the attention of Mr. Timothy Tomkyns, I am really disappointed with the Services delivered by Maleka Moalusi and His Manager, Karen Grobler I was a tenant in Carlton Mews, for over a year, 1 year 4 months. I had a great stay at the place but honestly, from the onset, the rental agency has been giving me poor service. On entering the place, no Entry Inspection was made getting the agency to actually come and look at the place was a mission. Fast forward to when I put in my 30-day notification. They were rushing to get me out & fill my place; and I was okay with that, so much so, that I even assisted in finding people to replace me on my lease. I brought to Maleka's attention that I had 4 applicants at the hand of which 2 really qualified to take over the lease. Maleka took so long to finalize everything, that the candidates decided to ditch and get the next available place. After this, I decided to wait out my 30-day notice, which I issued out on the 12th October and moving out on the 12th of November. Now when it came time to do Exit Inspections, with Maleka, Instead of doing Exit Inspection he decided to term it Entry Inspection. So according to my knowledge, I found what he did and incorrect and ********. I decided to confirm it with Nadia who then said that she couldn't issue out my Deposit because the inspection we did was not an Exit inspection. After all this trouble one would think that things became easier but no! With this company! Coordinating a smooth exit with Maleka was another mission. He kept on telling me that he would e-mail me updates of the progress; so much so, that I ended up having to call him each and every day, From the 12th of November to date. I even went to the extents of asking for updates via Whatsapp!! When I would eventually get ahold of him, he would always tell me a rhetoric answer: "In order to get the reasonable portion of my deposit due, maintenance needs to be and also I have to fix Stress cracks of which the Landlord, needed to fix. But due to naivety, I fixed them.

I did all of that, and what he recorded was just a clean-up needed, Which I told him, He can deduct from the Deposit, (R12,100). So after Maleka promised to give me an update on how it goes, He gave me a runaround, Which then, I decided to contact His manager Karen. Who then promised to refund me R7, 800 excluding the Maintenance I did costing R1,693. Which she said that the Landlord would pay me, back, But She assured me that she has done the payment on the 29/11/2017. She even stated that she transferred the cash, through my ABSA account, mind you, the company uses ABSA bank as well. I didn't even receive a notification backing up her statement, My Wife even asked her for some proof of payment. She then Blocked my Wife, from Whatsapp and Blocked me too. She refuses to take our calls now, along with Maleka. My Question is why the lies, it's been over 3-weeks, after vacating the premises, And they still finding difficulty paying to back the portion of my Deposit, which agreed upon after the inspection. I'm really disappointed at the Lies being told to me, Not sure if they realize that I work in a FinTech company. I know how the technology works. We are planning on opening a case against them, and the Company. This is ********** behavior under a written contract. If this cannot be solved peacefully we find ourselves having no choice, but to take legal action as well. I'm really disappointed at how Maleka and Karen, have treated me, I was a loyal paying Tenant, caused no issues at the Residence and this is how they choose to treat us. If this is how SA Investor Treats their tenants and possibly future tenants. I'm not willing to take any part of them and would advise my friends and those close to me, to never conduct business with them. Mr. Timothy Tomkyns could you please answer me.

Thank you for bringing this to our attention. Mr Tomkyns is no longer an employee at SA Investor Rentals and therefore a representative from the HR department of the IGrow Group will be responding to your review.

Due to it being your decision to give early notice, we feel that we did not rush you in vacating the unit and most definitely appreciate your efforts in trying to find a new tenant. When early notice is given, a tenant is generally liable for the next month’s rental (CPA penalty). However, due to your effort we felt it would not be fair and only charged you the pro rata rental amount for the 12 days that you were in occupation.

Maleka has done two inspections at the property. The first inspection was done with the intention of the applicants’, that you provided, moving into the unit. After we were notified that these applicants were in fact not going ahead with the lease, Maleka then did the exit inspection for you. We can provide you with this report if you request this.

With regards to the deposit of R8 342.28 (not R12 100.00), the deductions from this amount were as follows:

1. Cleaning of R720.00

2. 12 days pro rata rental for November of R2 419.99

3. Amount held back for the locksmith of R 1000.00 (this estimated amount less the actual cost of replacing the lock will be refunded once Karen has the invoice from the Locksmith)

The refunded amount of R4 202.29 was paid on Wednesday, 29th of November 2017, not long after your call to Karen, of which she has provided you the proof of the transaction. We do however apologize for the delay in providing the proof of payment. We unfortunately do not have control as to how long it will take for the funds to reflect in your bank account as this would be the banks concern.

Regarding the amount of R1 693.00, the owner will be asked to refund you the cost of the Polyfilla and putty knife (R74.00) that was used to fill the stress cracks in the unit. If the owner refuses to do so, SA Investor Rentals will gladly pay the amount of R74.00 immediately into your account.

As a company, we strive to respect our employee’s privacy and this includes their personal cellphones. However, Karen has been in communication on several occasions with you on Wednesday confirming all of the above. Furthermore, she can be reached via her work email or on the office line.

Karen has confirmed that you were a reliable tenant and we would gladly welcome you back at any stage.

We apologize for any confusion or unhappiness that has been caused and hope to maintain a professional working relationship with you.
