Contractor will not return deposit. Work was not completed.

The owner of the business did not complete work that he was contracted to do. We have repeatedly requested a refund of the deposit that was paid to him before work commenced to no avail. Concession after concession was given. We even conceded that the deposit be returned in three instalments as requested by the contractor. His services are no longer required but we want our deposit returned.
