J.J.Kruger I, Jacobus Johannes Kruger, hereby declare the following: I am a white male, ID nr *** 088, Contact nr ***, resides at Plot 218 B*****k street Waterval Pyramid 0120 , and are employed by Bidvest Protea Coin as a instructor at plot 36 Steenbok street, Wahlmansthal, Hammanskraal. On First July 2021 I bought a Ferrari Dino Kit Car with an Audi Quattro gearbox from Mr G P Bierman for the amount of R20 000-00, his business name Rusty rides at corner of Lavender road & Erras street Wonderboom Pretoria 0182 his Cell contact nu: *** . He informed me that he have no problem that I can leave the car there until I am ready with trailer or load bed truck to move my vehicle to my house at B*****k street Waterval and that the vehicle containing the Quattro gearbox will be kept safe at his business premises. He pushed the vehicle in to his yard because vehicle was standing in front of his business premises. On 9 July when I arrived with a trailer to fetch my vehicle the Quattro gearbox was missing, he started confronting and yelling at his staff and said that he will put everybody on the premises on a polygraph test as well as his dad’s employees and that he wanted the gearbox back by Monday the 12 July 2021.He ask me if I knew any polygraph examiners and He also ask me to give him two weeks’ time to look for another Quattro gearbox. On 12 July 2021 at 11:13am I send him a WhatsApp message and asked him if I must still arrange for a polygraph examiner, He response back at 11:14 was “More more oom,dit is nie nodige nie dankie oom ek weet wat ek weet ek gaan net nog verder geld verloor.Dankie in elkgeval.” I reply back at 11:15 and ask him if he found the gearbox. He was not responding back. On 22 July 2021 at 12:23am I sent an WhatsApp message to Mr Bierman and ask him: Ek hoop jy kon al n Quattro gearbox gekry het,jy het gese ek moet jou twee weke gee more is twee weke verby”.at 3:54pm he reply back to me “Nee ek kry nie een nie oom,weet nie waar ek weer so ding gaan uit grou nie.As oom wil moet ons die kar terug kry by my dat ek hom verkoop vri oom sodat ons net jou geld kan terug kry en al die uitgawes tot dust ver te cover…Ek kan nie nog geld verloor op die deal nie oom.” I reply back on 22 July 2021 at 06:09 and send a WhatsApp message “Ek het n plek gekry hul vra R6000-00 vir a Quattro gearbox ek het al klaar R2500-00 se Fibre glass gekoop. At 6:13pm I send another WhatsApp message to Mr Bierman Hul vra eintlike R13000-00 maar omdat my broer n pastor is, en hul ken vra hul ons R6000-00 hul maak geen wins nie. Mr Bierman didn’t response. On 23 July 2021 at 09:00 when I arrived at his premises and ask him why he didn’t read my WhatsApp message because we can get an Audi Quattro gearbox for R6000-00. His attitude immediately changed to aggression and he verbally informed me that He will not lose any money on this deal and that he is willing to give me a vw gearbox (Beetle) instead of the Audi Quattro gearbox as it is too expensive. I explained to him beetle gearbox is too weak to handle a Lexus 3UZ V8 engine and I did not pay for a beetle gearbox he then told me I can go and see a Lawyer because he also knows a lot of Lawyer, he will not lose any money further. I left his premises and inform him that I will not leave this matter because he verbally guaranteed me that the vehicle and gearboxes are safe on his premises.
