RTI AUTO SALES SOLD US A DEFECTIVE AND UNSAFE VEHICLE.

Good day On the 15th December 2018, I Taryn Celliers bought a 2005 Opel Corsa Lite 1.4i from RTI AUTO SALES, a second hand car dealership in Alberton, 74Fourth Avenue, Alberton North.. There were only 3 defects that were disclosed to us upon purchase of the vehicle: 1. The gear shift selector in the engine compartment needed replacing. 2. The windscreen was cracked 3. There were a few dents disclosed to us, but nothing we weren't prepared to accept. We were requested to sign their Terms and Conditions, which was not discussed with us in detail, we were not given the opportunity to read through them thoroughly and we were not given a copy.. We were told by the salesman, Tyrone Tolken, that it was not necessary to read through these T & C as they were old and put together before the new Consumer Act was enforced.. They only needed my signature to proceed with the cash sale.. 20 min after leaving the dealership,on our way home to Pretoria, the vehicle broke down on Heidelberg road, driving towards Carnival city direction.. We were advised by other drivers that the car was leaking fluid from under the vehicle, and upon getting out of the car and checking we noticed all the water was out.. At that point we were unaware of the cause of the loss of water.. We contacted the salesman, Tyrone Tolken immediately and made him aware of the breakdown.. We managed to get the car to the nearest garage, where upon my husband, Shane Bellamy, discovered that the water pressure tanks cap was not tightened properly, but didnt know the reason for this.. We filled the car with water and proceeded to return to the dealership.. We were contacted back by Tyrone and advised to take the vehicle to their workshop, in New Market, Alberton, where the salesman Tyrone Tolken advised us he was awaiting our arrival. He was not present when we arrived and the mechanic, Darryl let us onto the property. Tyrone never arrived. We explained to the mechanic what was happening, not only the loss of water but the car was very jerky.. Darryl proceeded to inspect the vehicle, realizing that the loss of water was due to the cap not being tightened. The following was then also discovered, things that were not disclosed to us upon purchase: 1. The M.A.P sensor was not working at all 2. The idle throttle sensor was not working. 3. There is a cam oil leak (as mentioned by RTI'S MECHANIC) Apparently these items were replaced with new ones, but no receipts can be provided as proof that they were replaced, as we requested them. The mechanic managed to jipo the engine somehow, just to enable us to get home to Pretoria, otherwise we would have been stranded, with no way home in Alberton if the car was not jipoed by the mechanic. The jipo remains 2 days after purchase of the vehicle. Tyrone, during our ordeal proceeded to switch off his phone and we could not get hold of him again that day. As we finally proceeded home we discovered that the wheel bearings are on their way out, by low grinding noise when turning right or left. We were not completely sure, so when we eventually got home my husband suspected wheel bearings, so he wiggled the wheels and found play on 3 out of the 4 wheels. We also discovered that the brake lights are faulty, possible electrical short, there is no spare wheel nor a jake in the car either. Non of these issues where disclosed in anyway to us upon purchase of the vehicle, deeming this vehicle, Opel Corsa Lite, extremely unsafe and dangerous for us as well as other road user's. Upon reporting these issues a day after purchase, we have been told that the dealership is not responsible for the repairs and the state that the vehicle was purchased in and proceeded to tell us that these were usual wear and tear items, that myself and my husband could not have caused the wear and tear on these items in merely a 2 day period. They proceeded to tell us that it is not against the law for them to sell an unroadworthy, unsafe vehicle. I requested a copy of their T&C's and they have included 2 clauses that contradicts the Consumer Protection Act on sales of second hand goods.. These clause's were not mentioned, discussed nor explained to us in detail before the purchase was made and signed for. We were in a financial predicament, where we had to sell our safe, reliable and roadworthy vehicle, in order to survive through December, and still find a bit cheaper vehicle to still be able to work and survive through December. This was explained to Tyrone, RTI SALESMAN. He guaranteed that the vehicle would get us to Pretoria, no problems and that we had 7 days to report any major engine or gearbox problems, but when we did, we were told it's not their problem and they refuse to repair any of the issues only 2 days after collection of the vehicle.. According to the Consumer Act, it is our right to have a vehicle bought from a 2nd hand dealer, in good running condition, so we are able to continue to carry out our daily obligations and work, which the vehicle was bought and intended for. We are in NO position to repair a vehicle that should have been repaired by RTI AUTO SALES upon purchasing it from the previous owner, knowing full well what the issues were, and ensuring it was in proper working condition for the next owner, especially since they have their own workshop and mechanics on hand daily. Please warn other's of this dealership as they can and will put your life in danger without thinking anything of it. If there is anyone who is able to assist us with this matter, please, this dealership is refusing to take responsibility for any of these defects and we are desperately in need of assistance with this matter.
