Breach of Contract - client out of pocket

RkD Projects / Russell Duminy was appointed as the builder / project manager on our home renovations in March 2014. Regrettably our experience with this contractor has been a very traumatic one, as the contractor has failed to return to site to complete the project within the agreed time-frame (as per contract) despite having received 100% of the funds for the project. The contractor has also failed to account for the monies he has received from the client, with no explanation for where our funds have gone. Current independent QS report deems the project only 56 - 58% complete despite full funding being received. <br> <br> Regrettably we had no option but to terminate the contract. We have attempted to comply with his initial request to settle the matter out of court, but when he failed to commit to a negotiated meeting with our attorneys we were left with no option but to complete the project with another contractor and pursue the matter with RkD via litigation. We have also been advised by one of his suppliers that they are in the process of suing Russell Duminy for not receiving payments on goods installed to our property (and 2 other properties which RkD was involved).
