Failure to honour guarantee

<p>I bought a bed (Matrix Vox kingsize extra length) at bedbuys value centre in Ottery (Cape Town) on 22 May 2015. (Since relocated to Gauteng)</p> <p> </p> <p>I’m a bit disappointed because I was promised it’s a good bed and I won’t have any issues with it.</p> <p> </p> <p>After two years, the mattress has sunken in on the left-hand side which obviously causes a lot of discomfort when trying to sleep on it, current guarantee is 30 monhts with more than 6 months left on the guarantee.</p> <p> </p> <p>I almost paid R9000 for bed, I would expect the bed to last much longer than 2 years, and it hasn't even lasted that long.</p> <p>I emailed Pieter Lourens at Rest assured and he advised that their showroom would contact me and arrange an inspection of the bed. Which they did and someone showed up and inspected the bed. He didn't share his findings but instead said they would send an email.</p> <p>Below was their response in the email:</p> <p> </p> <p>"Please see attached a copy of our warranty document. I refer to point 5 on the 1st page where it states “Rest Assured reserves the right to refuse services when upon inspection, the article is found to be dirty, stained or in an unsanitary condition …’</p> <p> </p> <p>However your mattress was also tested with the SABS Measuring Equipment and it was within the SABS Specifications we adhere to."</p> <p> </p> <p>First off can't see what the marks and stains has to do with the springs being defective as there is a hole that you sink into and can't sleep on the left hand side of the bed.</p> <p> </p> <p>We relocated from Cape Town to Gauteng so there would be marks on the bed.</p> <p> </p> <p>They site the warrantee but forget to mention or even acknowledge that the bed is still under guarantee.</p> <p>The bed is definitely not unsanitary as per their warrantee clause.</p> <p> </p> <p>I find it appaling that they are trying to avoid their guarantee obligations and not replace the bed.</p> <p> </p> <p>My wife has back pain from sleeping on the sagged, sunken side of the bed.</p> <p>We currently can't use the bed because the one side cannot be slept on.</p> <p>I have threatened with legal action and will carry through with it.</p> <p> </p> <p> </p> <p> </p> <p> </p> <p> </p> <p> </p> <p> </p>
