Unfair treatment,**************** and ignorance by Rental Pros
I signed a lease agreement with Rental Pro in 2016. I have never defaulted with rent at any given point. When I moved in the flat the bathroom light had no shade (which they now want me to pay for), I am not liable for that and the agent Cas Briel knows it very well). On the 18 April 2018 I sent the below email to them: "Good day, Would it be possible to get a burglar gate in the living room?I have a 2 year old,she likes to climb and she can easily open the sliding door to the balcony,it really scares me. Your most urgent assistance will be highly appreciated. Regards, Sinazo Landela" I never received feedback on this email, and I kept following up, but even my agent never bothered to respond to the email. Weeks went by, and I kept sending emails trying to get feedback, because I was so frustrated as I have a very hyperactive child, I really needed the burglar or someone at least give me feedback (STILL NOTHING! No one responded) On 09 July 2018 I sent an email to inform the agency I was moving out of the flat (please see email below): "Good day, I hope this email finds you well. I would like to inform you that I am moving out of the flat at the end of the month. I would like to serve my 22 days notice as of today 09 July 2018. Regards, Sinazo Landela" The reason why I moved out was because I needed a safer place for my child, and it was very frustrating for the agency not to respond to my emails, a little bit of decency to respond, whether to say yes or no to get the burglar gate would have been appreciated, but to ignore me when I needed help, as if I was staying there for free was TOTALLY UNFAIR. A few weeks later, after I sent the notice period email, I received an email from the agency that if they do not find a tenant for the month of August I will be liable for August rent (because it's on the lease contract and that I signed). ISSUES: 1. With all the emails I sent, requesting a burglar door, with no response from the agency, what should I have done, wait for my child to die for me to move out? -As far as I know, that's not part of the "treating customers fairly" principles 2. The agency is now claiming that I am liable for the August rental amount because I cancelled a lease agreement within rental term and they will blacklist me if I don't pay that amount. 3. What is the point of serving notice if they will still want me to pay for rent, when I'm not even staying there? I requested them to send me proof that reflects the date when the flat was advertised to find a new tenant. The reason why I requested this, there might have not advertised the flat, but want me to pay because "I signed a contract". I need proof that they advertised and they never found someone. There is a lot of people looking for flats,each and every month, and there is absolutely no way they wouldn't have found a new tenant because I gave them notice on the 09th July 2018. 4. When I moved out, I left the flat spotlessly clean, and on the inspection report ( which I asked them to send to me) it only says, they needed to paint the walls (which I don't have an issue with),but now they are also claiming R500 for cleaning the flat?????? Why was it not noted on the inspection report if really the flat was dirty?????? What were they cleaning because I cleaned the flat when I left?
I was not treated fair by the agency, and right now they are using "law" to protect themselves.
