eviction advise
<p>Dear Hello Peter,</p> <p>Kindly receive my request for an assistance regarding the following matter. I have rented a property from Renico Construction for a while. At some stage I fell into arrears of my rental property in Ruimsug. On the 16th February 2016, I was evicted from the property with none of personal belongings from the house. The owing amount was said to be +/- R19k as per statement. Please not that there was no notice of eviction or warning. My personal belongings were locked in the property.<br />In August 2016, I paid up the total amount of +/-R31k TO Renico Construction acount. I struggled to get my belongings that were moved to their storage out of my knowledge.</p> <p>I sent the proof of payment which was acknowledged by Michelle Taylor. Later, there was no paid up letter issued to me till to date. Michelle referred to their attorneys for paid up letter. On the 4th November 2016, A judgement was attached to my name at the transunion. Please note that there was no summons letter issued to me neither the letter of demand to notify me of the judgement attachment till todate. There was no sherrif letter issued.</p> <p>I reverted back to Renico - Michelle, She was still unable to assist with a paid up letter and tossed me round. She keeps reffrering me to Renico attorneys who attached a judgement. During contacting attorneys Office (CR Bothma & Jooste Attorneys) . I spoke to Gwen who informed me that I will need to pay R1200 for their company to remove the judgement as the company is not responsibe and liable to remove the judgement " in her own words".</p> <p>Later in that week I received an update email that advised that I owe legal fees of +/- R6k to Renico Attorneys known as CR Bothma & Jooste Attorneys. Mind you my name is still attached to credit beareau, my personal belongings were damaged and ****** in the process from Renico storage and was dissmissed when I was trying to enquire.</p> <p>I am hurting and inconvenience as well as miserable and dont know what to do.</p> <p>Kind regards,<br />Prudy S</p>
The undermentioned will clearly indicate that Prudy Serobatse has misconstrued the facts in order to hide her own wrongdoing:
- Prudy Serpbatse concluded a lease with Willowbrook X27 Property Investment Pty Ltd
- She breached the lease in that she failed and/or refused to pay rental, water and electricity for a period of 9(nine) months in the amount of R30 729-09
- CR Bothma & Jooste Attorneys, as instructed to do, issued summons and obtained judgment against Prudy in the amount of R30 729-09 together with interest and legal costs in the Magistrate's Court for the district of Johannesburg West, held at Roodepoort under case number 7512/2016
- Prudy subsequently settle the rental, but refuse to settle the legal costs and interest
- Willowbrook X27 Property Investment Pty Ltd consented to the judgment being rescinded subject to the interest and legal fees being settled in full
- the Judgment obtained against Prudy cannot be rescinded until such time that the legal costs and interest are settled.

I Pleade to Hello Peter to request to request a copy of the statement to all the payment I have made to them in order to analyse my non- payments of 9 months stated by Renico Construction. I was evicted with only clothes I was wearing on the 16th of February 2016 with no other personal belongings in the house. This now is misinterpreted as absconding from the property. At that particular time of eviction I was served with arrears of +/- R19k. There was no notice or letter of eviction. I was charged rent and electricity for February, March, April and May 2016 - which added up to that +/- R30k arrears stated to be total of nine months arrears. In my knowledge that was not stipulated on their breach of contract or what so ever. I am dissapointed that such a big reputable company can bear a personal grudge like this and act out of contract. I am an individual and unable to be drained any unnecessary money that I truly dont have. i request fair treatment without any ************** from Renico.

It has been done on purpose for the summons to be issued to the same property I was evicted from up until the judgment was attached by the court in favor of the CR Bothma and Jooste attorneys. I am an average South African citizen with no private attorney and neither can afford one. I feel the process was dealt with unfairly.
