Third party claim denied
<p>i sent the guy who hit into me with a letter of demand, OCLS responded on behalf of their client . I sent all the necessary documentation they requested and within 5 days I got a response saying my claim has been rejected and I will be recieving a letter of demand based on their clients statement . How is that possible? Shouldn't they investigate properly before making any judgments ,why was my statement and the witnesses statements not taken aswell? Makes me question are their competency </p>
We have every reason to take our insured’s narration of events at face value due to the doctrine of good faith. We have no right to read into our insured’s version what a third party may want us to read in, nor are we obliged to take a third party’s version over that of our insured especially after having our insured furnish us his version in utmost good faith. According to our insured, he had right of way and third party came and collided into him. On that premise alone we had to deny liability and send our letter of demand as there was prima facie evidence that third party was in the wrong.
