Legal or not? SO unhappy.

So we had our phones insured under this insurance for a certain amount, surely we need to be paid out that value or get a phone to this value of our insured amount, instead we receive the same phone which is new, basically the new phone they giving us is now at a much lesser value than our insured amount, how legal is this?
