Defective Workmanship Claim repudiated by Renasa!!!

I submitted a claim to Rensa through my brokers for " Defective Workman ship" i pay every month and under the impression that all is covered only to get a letter from Rensa stating that the claim is repudiated.The reason they give is that the bike was in my custody when the bike broke.Now explain to me why would i submit a claim other wise for defective workmanship , my guys made a mistake and we caused damages to a clients bike surely this is Defective Workman ship.I have spoken to numerous other insurances companies and they all informed me that we have a Valid claim Renasa???.Now they cannot give us a proper answer to my knowledge they are telling me that if we work on a clients bike and we damaged or cause damages due to defective workmanship they only cover when the bike has left my shop and is in the hands of the client.Now explain to me if we brake an engine how can the client take his bike before i submit a claim.We submitted all documents as requested the client is holding us responsible for damages caused by Defective Workmanship.Its been weeks and still nothing i am not impressed at all about this service and lack of communication we are getting in the mean time my clients wants his bike back...What must i do ???

The complaint relates to damage to a motorcycle whilst in the complainant's custody and control. The policy, a contract of insurance, is very clear where the item has not left the custody and control of the (in this instance) repairer. As with all contracts of insurance, there are terms, conditions and exclusions. In the applicable section of the Policy, under Specific Exceptions, the Insurer will not indemnify the insured in respect of damage to 2. Property (a)(ii) property in the custody and or control of the insured or any employee of the insured. In addition to the exception, above, the policy further excludes at (b) that part of any property on which the insured is or has been working is such damage results directly from such work.
