3rd Party Offer absolutely ridiculous!!!
3rd Party Claim RENASA – SPM 370496
Absolutely ridiculous feedback and offer received.
On the 30th of November 2017 a driver made an ******* u-turn from the left lane across the road straight into the side of my vehicle!
The driver’s own police report states this!
THERE WAS NO WAY OF SWERVING OUT TO AVOID THE ACCIDENT. I had to sign a document to say I was not claiming from my own insurance with all other documents that needed to be supp**** to Renasa before they took the matter further. On around 19 Dec. I got a mail to say that the assessor will not even look at my vehicle and they will just look at the photos of the damage. In mid January, they sent an offer of R13 818 after doing some creative maths. The cheapest quote I could find was just over R30 000!
The offer was for 60% of a lowered amount because they said it was only 60% the fault of their client!!! How crazy is that? And after they knew that it was not the case!!!
After enquiring about it, they sent this letter:
'The above matter refers. OCLS holds instructions to act on behalf of Renasa insurance. The law expects every driver to exercise due caution even when on a through road and having right of way, keeping watch of vehicles that may encroach from either side. The courts have made it clear that there is nothing absolving every driver from exercising due caution regardless of the fact that they may have right of way. In our current case the third party driver had an obligation as a reasonable driver to take precaution to avoid the collision. While we do appreciate that his onus was lesser than that of our insured driver who was more negligent, the law does under such circumstances impute some degree of negligence – in our view 40%, taking into account industry practice and previously decided cases, hence the 60% straight offer we gave to the third party. I trust the above makes sense.'
I then approached my attorney firm who sent a letter of demand. No response from anyone!
If you are insured by Renasa, think twice. Their client is now facing legal action.
I have a pregnant wife and I am a commission earner. I cannot see clients with the smashed vehicle and this is having a major effect on my finances. I am not asking for all the extra damages and costs yet!!!
All I want is to fix my car to the way it was before the accident.
