3rd party claim SPM 411193.
On the 26th July 2018 our vehicle was involved in an accident with a Renasa client. We were traveling straight on Koeberg road when their client took a right turn face on into oncoming traffic smashing into our vehicle. At the scene their client assured us that her insurance will have our vehicle sorted as she misjudged the intersection with another robot a few meters ahead. When I contacted their client the next day for the claim number she abruptly told me that she had not contacted her insurance yet. Yet renasa already getting ready to collect her vehicle at the storage facility where our vehicle was also stored. She refuse to give me the claim number and had to personally approach Renasa offices and explain my situation before they could refer my to whoever was handling the claim all while their client continued to lie about the claim not being submitted. Already here I smelt a rat. I was refered to Thames brokers who handed the case over to Oxford legal Services after I had submitted all the needed documents including repair quotes of R88000 and R84000. After constant calls after them they came back with the following email:
Good day,
The above matter refers.
OCLS holds instructions to act on behalf of Renasa Insurance.
Kindly note that the offer was calculated on a 60% /40% apportionment for Toyota Hilux
Your quantum R42 630.00*60%=R25 578.00
Our quantum R35 760.86*40%=R14 304.34
R58 750.00-R17 625.00=R41 125.00/1.15
Total R25 578.00 - R14 304.34 =R11 273.66
I called them immediately and asked them to provide me with proof of our 40% fault. According to their clients statement that they received. We had jumped a red smashing into their client.
1. There was no red robot to jump as they were in the very early Process of erecting robots. No new road markings or paint layout was changed. They road and markings we were traveling on still indicated for us to proceed straight ahead. 2. The impact on our vehicle was hit on the driver fender side while their client was whole front damage. So how we side crabbed into the front of her vehicle is totally mind boogling. According to witnesses at the scene this is the 2nd accident that their client has caused in a short period. Their client is quite known to them as she resides and has a business in the area of of where the accident happened. 3. They had dramatically declined the value of our vehicle to R60900 which we paid R120000 for a month prior to the accident and funny enough they seemed to have gotten her vehicles value just right. They have stated that our vehicle is a write off and wanted to offer us ' Oxfords legal services' market value of R60900
When providing proof and photograhs that their client had **** and laid a false statement. The response from her Broker was " Well its your word against hers" I also provided them proof of more or less what our vehicle is being sold for on the market. There is NO WAY that I would be able to purchase another 2006 Toyota Hilux D4D LWD accident free vehicle for R60900.
After this I made it my mission to get a witness statement and I got one from the official that was at the scene. After sumitting the witness statement I was told to wait another few days only for Oxford to tell me the very same story as per mail above. They even allowed their client to change her statement so that it could count in their favour once again despite the evidence, accident sketch, report, photograhs and witness statement that I have submitted. Why was the witness not contacted with the provided number? Because Oxford didnt want anymore proof of their clients wrong doings.
I will be approaching legal assistance if my claim is not settled. This is our work vehicle and it has been off the road since the accident depriving us of our income. While their client is allowed to drive recklessly on the roads and destroy peoples lives. The accident has caused us so much inconvenience and suffering. Why? Because Oxford Legal services will cover their clients wrong doings no matter what. There are just lies, lies and more lies coming from their client and Oxford just plays along. I refuse to be a 'victim' of their clients reckless driving with the help of Oxford
