SOLE MANDATE *****_UP

<p>I gave a sole mandate to remax which I just retracted.</p> <p>The property is not even listed anymore. I gave a sole mandate because I thought my interests wil be looked after by Remax.</p> <p>I lost allot of money on a previous Offer to purchase due to bad service.</p> <p>During the time when my property was actually still marketed the agent came to me with an offer that had to effect that the purchaser would like to buy the property but under the condition that he first got the property zoned more densely. he had six moths to get the re zoning done otherwise the purchase is not binding. We agreed to same with the condition that the purchaser pays "occupational interest" during this time.</p> <p>After sending the contract back a few times to the agent due to bad drafting we finally signed the agreement. Not realizing that there is still a major flaw in the contract.</p> <p>During the six month period the few payments of occupation rent paid into the transferring attorneys account was never paid over to me because the purchaser never comp**** with his FICA requirements. Where is the agents obligation to obtain same?</p> <p>When it became apparent that the purchaser was not abiding to all the occupation rent payments I consulted a litigation attorney to assist in retrieving the contracted amount only to receive a massive bill and a letter stating that due to the clauses in the contract I am not entitled to occupation rent as occupation rent is subject that all suspensive conditions is fulfilled and one of the conditions was that the zoning is approved and if approval is not granted the whole offer lapses. So my request to safeguard myself against the cost of holding on to the property while the purchaser obtains zoning changes was completely ignored/by-passed/ not adhered to due to lack of knowlage.</p> <p>Now the attorneys refuses to pay me the occupation rent, I had to pay an attorney to tell them the money is not mine, my property is not even marketed on the Remax site anymore and during all of this Remax gives quality assurance.</p> <p>Please advise me as to what this assurance entails?</p> <p> </p> <p>When I tried to post this to their site I recieved an 404 message the whole time...</p>
