REMAX LEGEND WITBANK - POOR MAINTENACE AND MANAGEMENT OF PROPERTY

In 2022, we had tenants in our house through Remax Legend Witbank. They moved out at the end of November 2022. Afterward, Remax found new tenants for us, who moved in on December 1, 2022. According to the Agent, an inspection of the house was conducted, and we had full confidence in Remax that everything was in order. There were a few minor problems that the agent said she would fix with the deposit money. When the new tenant moved in on 1 Dec 2022, I told the agent that we would give them 6 months to make an offer on the house. She said they were interested; they just needed more time. On February 3, 2022, I asked the agent if the people were still interested, to which she rep**** that they were interested but nothing had happened. On April 13, I asked when the inspection was done because I received complaints about the condition of the house. The agent responded that another agent had recently been there. On May 26, 2023, I once again asked for someone to inspect the house, and I received a reply stating that the house was neat and well-maintained, which I accepted in good faith. On June 7, I requested photos of the house and received them on June 8, taken from outside through the windows (note: without the tenant's permission). Agents message read as follows: 'It's very neat and everything is clean and in order. We checked everything inside the house following our inspection.' In the first week of October, my husband made an appointment with the tenant to show people the waterproofing that needed to be done. When he arrived at the house, there were several problems, including a inside fire place that is made of small stones blackened with the ceiling roof, showers with Mold, damaged walls, damaged doors, etc. On October 10, 2023, we arranged a meeting with Agents and Tenant and ourselves homeowners. During the walkthrough, the agent took notes of all the improvements that needed to be done. On that day, the tenant informed me that he was told he couldn't buy the house until he had rented it for at least a year, which was a stipulation in the contract (there is no such stipulation in the contract). The agent showed me inspection documents of November2022 on the same day, listing the problems in the house that were only pointed out in October 10, 2023. She mentioned that the previous tenant, had left the house in that condition and that tenant deposit was still in Remax's account for the last 8moths without any improvements being done to the house. Meanwhile, the new tenant and his family have been living in the house with all the damages from the previous tenant for a year. Attached on November 20, I asked both the tenant and agent what is still outstanding and if everything has been done. Agent rep**** that everything in the house has been done, but contradictorily, the Tenant said there is still outstanding work. He sent me photos, November 21, showing the repair work that should have been done by Remax. Both my husband and I are very unhappy with how we, as clients, are being handled, that our house was damaged over a year ago, documented, but never fully restored. I believe if you were a homeowner, you would also be upset to see your house handled this way. Our real wooden door has been painted black to cover the scratch marks from the previous tenant's dog (we will never get the original wooden door back, requiring a new door). Holes haven't been properly sealed, and the wall has several patches of paint. Stickers have been removed from the wooden doors of the rooms and left as is damaged. Even after a year, the tenants still don't have keys for the outside door, and who knows what else is wrong with the house. If an inspection had been done as we were told earlier in the year, stating that it was done and everything was fine, we wouldn't be facing this problem today. If the deposit hadn't been held a year back, the repair work would have been done. But now, it's mid-November 2023, and the repair work that was supposed to be done in December 2022 still hasn't been completed. I have all the messages and photos to support this email if you need them. Agent keeps on saying that repairs will be done but nothing is being done.
