Refusing to pay back deposit
We rented a property through Remax Infoglobe. During the renting period, numerous emails were sent to the agent regarding the oven that did not work properly. One night the oven’s element caught fire while making dinner. The owner refused to fix the problem since it was past the 14 days to bring any defects to the attention of the agent/ owner. The agent was informed in week 5 since they were closed for the December holidays. Except for the oven, there was numerous other problems as well. But the oven was the main concern since it was a fire hazard. After numerous emails and photos and calls, nothing was done regarding the oven. The agent then advised us via email, to give notice and then she will assist with finding another property to rent. After considering all our options, we decided to give notice since the agent advised us to do so. We gave 2 months notice as per agreement. Now, they refuse to pay back the deposit, stating that we breach the contract ( which was for a year). As per CPA, 20 business are allowed to cancel a contract, and 2 months was given. (There is also no early termination fee clause in the agreement). Now they penalize us for following the recommendation of the agent to give notice and because the oven was not fixed. They refuse to pay back our deposit. This is unacceptable.
