Horror / nighmare treatment

Good day

RE: COMPLAIN ABOUT ALTA BOTES OF RE/MAX All Stars AGENT COMPANY: ALBERTON

I was renting Unit 60 at Cricklewood Complex, Mulbarton and I was assisted by one of the agents, Alta Botes. At first when I moved in, Alta promised me that she would speak to the landlord so that the unit get renovated, painted and maintained after I have moved in. Taps were leaking, walls were dirty, and the unit was not cleaned, not ready at all for occupation. I telephonically informed Alta about the condition but she actually did nothing about it to the point that I had to hire people to help me clean the unit. I stayed for 1 year with a kitchen door that couldn’t lock, and the other day, I was from work, and I found the door open. I reported this too to Alta but she did nothing about it.

On the 8th June 2017 she sent me a letter that states that according to the TPN my rental contract has been terminated and that I should vacate the place on Saturday. Unfortunately I did not read my emails and obviously knew nothing about that. She personally came to the unit that Saturday and told me that I had to leave, however I requested her to give me until end of June as I try to find another place to stay; and we agreed on that. On Friday the 30th I started vacating the place. I then notified her on Saturday by sms that I had moved out and I even tried to contact her during the entire weekend but with no avail. On Monday the 3rd July 2017 when I called Alta again, I asked her if it will be possible for her to inspect the unit on Monday but she actually gave me an attitude, she actually told me she was not going to cancel her appointments because of me, she acted so unprofessional that she even hang up the phone on me. This was so unpleasant to me. She told me I was not supposed to have moved out until end of July, however, I indicated to her that she terminated the contract and even advertised the property for immediate rental occupation.

She then told me to leave the unit keys with the securities. I wrote her an sms saying I will not leave the keys with the securities as I do not trust anyone and I don’t understand why we should now involve the securities as I did not receive the keys from them. Yesterday we inspected the unit, I have never seen anything like that before, the way she was shaking the taps as if she wanted to break them. I then asked her how come you never did this kind of inspection when I moved in; why now. Proper inspection was not done before me when I moved in.

During our inspection yesterday the 4th July 2017, in the main bedroom, the wall underneath the window has a molt, you can see it was caused by water; however, I was surprised when Alta asked me how did that happen; her words were “but the wall was not like that”. I don’t see how that affects me, I don’t see how it is any of my problem or if I had anything to do with it. I don’t have control over such things. Kitchen units were not in a good condition too when I moved in. But to my surprise Alta was shaking her head whilst she was doing the kitchen unit inspection, I don’t know what that meant. My take is she wants to put blame on me about everything that is wrong in that unit mean while they failed to maintain. There were times where my rent would be late, however, that did not give Alta the right to treat me unfair or not to conduct herself in a proper manner.

She and I got into an argument to such an extent that I told her I was going to take the matter up even if it means ending up at court. She disrespectfully said to me “with what money cause you can’t even afford to pay rent”? I’m sure if I did not afford pay rent I would be on the street but that was not the case.

Alta did not act fairly and honestly and to the best of her knowledge and ability

Two weeks back I was told the landlord was going to inspect the place, I questioned why now? Why didn’t the landlord inspect the unit when I moved in.

I reported the matter to her supervisor Justin De Necker. My deposit refund was supposed was to be R9 000 which was supposed to have been paid within 14, but to date I haven’t received a cent from the agency; it is almost a month now. When I contacted her this morning (17 July 2017), Alta shouted at me, gave me a very unpleasant response, she told me never to contact her again and she hanged up the telephone on me. When I questioned her about the electricity bill she told me I should stop asking her questions and asked me why don’t I call body co-operate myself. I told her I never dealt with them hence I expect her to answer me. I received a statement from Alta, the agency, that my refund will be R3 912.00 from R9 000. Now that’s day light *******. When I questioned this, she told me it’s because there are damages. When I moved in that place was a mess itself, promises were made to fix the place, I trusted them. I cannot be held liable for the cost, the landlord failed to maintain the unit. All I want is my money. Taps were leaking, I hired someone to fix them, and they just told me they can’t accept that as some of the taps are still leaking, was I expected to fix every tap in the bathroom? Who responsibility is it? I paid the cost R1000; I took it from the rental money and paid them the balance of R4 200, and however they decided to take it from my deposit as well. I then requested Alta to send me all the quotes, to my surprise, Alta’s husband is the one who quoted me. How can that be possible?
